Insofern ist die Thematik von ständig aktueller steuerrechtlicher Brisanz. § 7 Abs.1 Satz 1 EStG bestimmt den Ansatz von Anschaffungs- und Herstellungskosten bei Wirtschaftsgütern, deren Verwendung oder Nutzung sich erfahrungsgemäß auf einen Zeitraum von mehr als einem Jahr erstreckt, entsprechend der gleichmäßigen Verteilung auf die Gesamtnutzungsdauer. Im Gegensatz dazu stehen die als Betriebsausgaben oder Werbungskosten sofort abzugsfähigen Erhaltungsaufwendungen. Aufgrund der zwei unterschiedlichen Rechtsfolgen ist es notwendig, die Anschaffungs- und Herstellungskosten sowie die Erhaltungsaufwendungen eindeutig voneinander abzugrenzen. Immobilien sind jedoch komplexe Anlagegüter, daher unterliegen einzelne Teile unterschiedlichen Verzehrbedingungen und müssen ersetzt oder repariert werden – die Abschreibung erfolgt allerdings bis auf Ausnahmefälle einheitlich. Der Gesamtaufwand für Immobilien setzt sich also aus den Anschaffungs- oder Herstellungskosten und den während der Nutzungsdauer erfolgten aufgewendeten Kosten zusammen, und eine Trennung dieser Kosten ist nicht immer ohne Probleme möglich.
