Pubblicato per la prima volta nel 1967, in un clima che annunciava le agitazioni studentesche e sindacali degli anni seguenti, questo libro fu accolto con diffidenza e, in molti ambienti, con imbarazzato silenzio. I temi fondamentali sono quelli dei libri e degli articoli con cui Giuseppe Maranini denunciava i vizi della democrazia italiana: la "dittatura" del parlamento, la debolezza del governo, lo strapotere dei partiti, le carenze della costituzione repubblicana. L'autore ricostruisce con questo libro una storia politico-costituzionale dell'Italia unitaria dal 1848 al 1967. Giuseppe Maranini (Genova 1902 - Firenze 1969) è stato un giurista, politico e pubblicista italiano il cui itinerario intellettuale ha percorso le tappe più significative della storia costituzionale d'Italia. Laureato in giurisprudenza, poi docente all'Università di Perugia, pubblicò opere sui sistemi costituzionali molto avanzate per l'epoca e nel 1933, poco più che trentenne, divenne professore ordinario. Con l'emanazione delle leggi razziali rischia di essere sospeso dall'insegnamento in quanto figlio di madre ebrea, ma ottiene di insegnare nel 1940 all'Università di Firenze, ove pubblica i suoi articoli sul periodico L'Arno, una testata locale che rileva diventandone finanziatore, stampatore e redattore. Nel dopoguerra intensifica l'attività giornalistica scrivendo articoli di politica costituzionale per Il Resto del Carlino e La Nazione. Nei primi anni '50 diventa editorialista del Corriere della Sera. Sulle pagine dei giornali conduce una serrata campagna contro la sovranità dei partiti politici e a favore di un governo responsabile investito direttamente dal popolo. Nel 1949 Maranini conia un termine che conoscerà un'enorme diffusione: partitocrazia. Nel '65 fonda Alleanza costituzionale, gruppo di pressione composto da insigni studiosi e parlamentari con lo scopo di proporre modifiche alla costituzione repubblicana in direzione di una maggiore separazione dei poteri e nella modifica della legge elettorale in senso maggioritario. Tra i firmatari i nomi più noti oggi sono quelli dei costituzionalisti Vezio Crisafulli e Pietro Rescigno, del politico Giuseppe Pella, di Paolo Rossi, filosofo e storico della scienza, e di Salvatore Valitutti.

International Relations and History were once academic fields sharing a common concern with the affairs of empires, states, and nations. Over the course of the twentieth century, however, they drifted apart. International Relations largely retained the focus on the affairs and relations of these principal international actors but took a methodological turn leading to higher levels of theoretical abstraction. History, on the other hand, retained the methods that define the discipline but shifted the focus, veering away from matters of state to the vast array of actors, events, activities, and issues that colour everyday life. In recent years, the drift has been arrested by scholars in each discipline who have turned towards the other discipline in their research. International Relations has undergone a 'historiographical turn' while History has taken an 'international turn'. Rise of the International brings together scholars of International Relations and History to capture the emergence and development of the thought, the relations, and the systems that have come to be called international in western discourse. The evidence offered by contributors to the volume suggests there has been no single, stable, unchanging concept or object of theoretical reflection or historical investigation that can be called 'the international', but a variety of historically contingent conceptualizations across different contexts.

This open access book can be downloaded from link.springer.com Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics. Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processes became palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.
