Trafficking in human beings (THB) is a serious crime, often committed by organised criminal groups and involving severe violations of fundamental human rights and exploitation of victims. THB represents one of the main threats to the internal security of the European Union and the freedom of its citizens. Eurojust plays a key role in the fight against human trafficking, which has been, and remains, high on the EU agenda as one of the eight priorities in the fight against organised crime between 2011 and 2013. However, statistics show that the number of THB prosecutions and the number of THB cases referred to Eurojust for assistance remains low. Together with Europol and other JHA agencies, Eurojust signed in October 2011, on the occasion of the 5th EU Anti-Trafficking Day, a Joint Statement to address THB in a coordinated, coherent and comprehensive manner. The joint effort includes assistance to Member States to increase the number of THB investigations and prosecutions and to coordinate cross-border action, so that human traffickers are brought to justice efficiently. In this context, Eurojust took the initiative in 2012 to develop a strategic project entitled Eurojust's action against trafficking in human beings. This report summarises the project's findings by attempting to answer the following questions: What are the reasons underlying such a small number of THB prosecutions and such limited involvement of Eurojust in THB cases? What can Eurojust do to improve the situation? This report also highlights the main problems encountered by the national authorities in prosecuting THB and attempts to present solutions for addressing these difficulties.

The strategic meeting on trafficking in human beings (THB) was organised by Eurojust in The Hague on 16 and 17 April 2015 as part of Eurojust's strategic project on THB. Over the course of the two days, prosecutors, judges, law enforcement authorities and THB experts analysed the challenges posed by the investigation and prosecution of THB cases. The participants included practitioners from the Member States, Japan, Norway, Switzerland and the United States of America, as well as representatives of the European Commission, Europol, the Fundamental Rights Agency (FRA), the United Nations Office on Drugs and Crime (UNODC), the University of Cambridge, Western Union and Facebook. The focus of the strategic meeting was how to strengthen and improve cooperation between national judicial authorities in the fight against THB. In particular, the meeting analysed challenges encountered in obtaining evidence from victims of THB and in prosecuting THB cases for the purpose of labour exploitation. It also examined judicial cooperation issues related to the use of JITs, the gathering and admissibility of e-evidence, the use of special investigative techniques, as well as financial investigations in THB cases. Last but not least, it analysed the value of Eurojust's involvement in THB cases and identified other areas where Eurojust could assist Member States. Prior to the strategic meeting, Eurojust circulated two questionnaires on THB, one addressed to the judicial authorities in the Member States, Norway and Switzerland and a second addressed to the National Members at Eurojust. Based on the responses to the questionnaires, Eurojust carried out an analysis and prepared a report. The report summarised the preliminary findings of the analysis and was distributed to all participants to provide background information for the strategic meeting. The report, finalised after the meeting, is presented in the Annex. The two-day strategic meeting consisted of plenary presentations and workshops that addressed specific aspects of THB.

This book explores the external dimension of the ambitious EU policy on human trafficking. Through this policy the EU institutions and Member States promote the eradication of human trafficking and support, to that end, cooperation with their partners, being third States or international organisations. Cross-border cases of trafficking in human beings (THB) are complex and difficult to investigate and prosecute. They reveal the prominent role of organised criminal groups. When gaps in judicial cooperation appear it is the victims of THB who suffer. In October 2020, the European Commission noted in its progress report on THB that judicial authorities in the Member States had raised serious concerns about difficulties in judicial cooperation. This report was prepared by the European Union Agency for Criminal Justice Cooperation (Eurojust), with the aim of responding to these concerns. It presents solutions used by the agency when assisting in complex THB cases requiring judicial coordination. The report also aims to inform the forthcoming EU strategy against THB. It expresses Eurojust's readiness to play a central role in the future strategy, by bringing substantial added value to the operational dimension of combating THB. The final aim of the report is to assist in successfully bringing human traffickers to justice, while protecting the victims. The report is divided into two main parts. The first part relates to the coordination of investigations and the second to victims' rights. The report draws on the practical experience gained from Eurojust's support of human trafficking investigations between 2017 and 2020. In total, 91 cases of THB were selected for analysis by Eurojust's anti-trafficking team, of which 31 are illustrated in this report. Each case highlights the diverse legal and practical problems faced and provides examples of good practice, followed by targeted recommendations. In total, 18 recommendations are made, which supplement the recommendations provided in previous Eurojust reports on THB. These recommendations are mainly aimed at prosecutors, judges and law enforcement authorities.

The unprecedented political events and security attacks that lately have been targeting the European Union had led the Member States to a deep reflection on the future of the European project and how the EU entities will enhance their response to the most immediate concerns of European citizens, such as security, migration and the reinforcement of an area of Justice and Fundamental Rights based on mutual trust. The political consensus for strengthening the EU instruments against terrorism confirms the key role that Eurojust is called upon to play in this area, requiring Eurojust to reinforce the fight against terrorism, violent extremism and connected criminal activities and emerging threats such as cybercrime and asset recovery. The continuing migration drama requires Eurojust's response to migrant smuggling and related crimes, such as judicial action against organised criminal groups, trafficking in human beings and drug trafficking. Member States expect a full range of operational services from Eurojust to ensure a robust judicial cooperation response at European level. The steady increase of cases referred by the Member States to Eurojust, which relate to more complex cross-border crimes and that require an increasing number of coordination meetings and coordination centres, highlights Eurojust's crucial role in serving justice across borders for a safer Europe. Despite the budgetary uncertainty resulting from the fact that this multi-annual programming document forecasts beyond the current multi-annual EU budget and that the discussions on the next Multiannual Financial Framework for 2021 and beyond will only start in earnest once the agreement on the UK's withdrawal from the European Union is concluded, the draft budget 2019 reflects the financial and human resources required by Eurojust to perform the increasing number of operational activities and to meet the growing demands for assistance from national authorities of the Member States.
