Excerpt from Street Railway Law, Vol. 2: A Digest of Important Decisions in All Parts of the Country, Covering the More Important Class of Cases Which Daily Arise in the Management of Street Railways for Managers and Claim Departments The erection upon a public street of an elevated railroad imposes no additional servitude; where an additional use of a street has been granted by the city authorities to build and operate a street railroad an injunction will not be granted to restrain the construction or operation of the road at the suit of an abutting property owner until the resulting dam ages to his property are ascertained and paid, but his rem edy is by action at law for such damages. The proposition that a railroad unlawfully in a street is a public nuisance and liable as such to be abated at any time, and therefore a recovery for damages can only be had to ithe time of bringing the action is untenable; the injury would be a continuing and permanent one; therefore a sin gle recovery can be had for the whole damages, present and future. The abutting property owner having a complete remedy at law, courts of equity will not, upon his allegation that the ordinance authorizing the construction is illegal, enjoin the defendant from proceeding until the question of illegality can be litigated and determined, but will remit him to his action at law. Excerpt from Street Railway Law, Vol. 4: A Comprehensive Working Compendium, of Important Street Railway Decisions in All Parts of the Country, Covering Practically All New Legal Questions, Including Promotion, Charter, Construction, Equipment and Maintenance Problems In presenting this, the fourth volume of street railway law, it appears scarcely necessary to make extended mention of the litigation concerning street railways and the need for managers, as well as claim agents-and attorneys, to be informed as to the deci sions of the courts. This book tells what the courts have decided, the matter being couched in language that will be understood by the layman as well as the lawyer. To quote from the preface to Volume III: In its preparation, the constant aim has been to omit nothing vital, to cover all points of interest of both law and fact; to give as much space as necessary to new and exceptionally important points, yet, on the whole, to be as brief as possible without sacrificing anything of prac tical value. It is much more full and comprehensive than an ordi nary digest would be, and is at the same time in about the same pro portion less bulky and more readable than would be the several vol umes that would be required to report the same cases in full. It is probably all that; managers or other street railway officers will care for in the way of reports on the cases covered, while such attorneys as desire to see and use full opinions, when the occasion requires, will find it a'good medium for locating such as they want, as well as a convenient handbook for many other purposes. The arrangement chronologically and something of the style are attributable to the fact that the work was originally prepared for publication in the Legal Department Of the Street Railway Review. However, it is believed that there will be more gain than loss in this last fact. The index, which has been prepared with a good deal of care, will make the contents of the book readily available.
