Eine umfassende Analyse der von der Kommission in Form der Rechtsaufsicht ausgeübten »zentralen« Kontrolle ergibt deren gravierende Mängel. Der Autor zeigt daher denkbare Lösungsansätze auf und bewertet sie. Es handelt sich hier zunächst um zentrale Ansätze, welche vom Ausbau der administrativen Kooperation zwischen Gemeinschaft und Mitgliedstaaten bis hin zu Weisungsrechten für die Kommission reichen. Diesen gegenüber stehen dezentrale Ansätze wie der Ausbau der dezentralen Kontrolle durch die mitgliedstaatlichen Gerichte und die Schaffung von Umweltinformationsrechten für die Gemeinschaftsbürger. Es zeigt sich, daß nur eine ausgewogene Mischung aus zentralen und dezentralen Ansätzen, welche jeweils die Souveränität der Mitgliedstaaten zu beachten haben, zu den erwünschten Vollzugsergebnissen führt.

This volume represents a historical comparison of the American and the EU European constitutional experiences and lessons to be derived therefrom for the present time. It is designed to deepen the understanding of the historical and political dimensions of constitutional designs and practises on two continents. The proliferation of international organizations is presently a hot issue. New international organizations have been created over the last few years, such as the Organization for the Prohibition of Chemical Weapons and the World Trade Organization. At the same time a certain reluctance may be observed to create new organizations. Overlapping activities and conflicting competences occur frequently and the need for coordination is evident. The events in former Yugoslavia are an example. Both during the armed conflicts in Bosnia and Kosovo and afterwards in the era of reconstruction, the need to coordinate the work of organizations such as the UN, NATO, the EU, the World Bank, OSCE, and the Council of Europe was vital. Against this background a number of legal issues have become more important that have not yet been researched extensively, perhaps the only exception being the proliferation of international tribunals. Questions include the following: Why were new organizations created while others already existed in the same or a related field? What specific legal problems have arisen that are related to the coexistence of different organizations working (partly) in the same area? What mechanisms or instruments have been developed to coordinate the activities and to solve legal problems? These and other questions were discussed during a conference that took place from 18 to 20 November, 1999, in the Academy Building of Leiden University, The Netherlands. A large number of experts, both academics and practitioners, participated. The purpose of this book is to present the issues discussed during the Leiden conference to a larger audience. This book contains the adapted papers for the conference and several other contributions.

It is beyond dispute that both China and the European Union stand to gain from promoting low-carbon development through the dissemination of clean and renewable energy sources, as this inevitably leads to increased environmental protection. The depletion of fossil fuel resources and the accompanying changes in the global energy mix make Europe and China not only competitors in the global economic race, but also nolens volens partners. Their pragmatic partnership is characterized, on the one hand, by the need to take action to reduce the consumption of fossil fuels and, on the other, by the desire to minimize the negative environmental impact of their use. Hence, the existing and emerging cooperation between the two actors, while challenging for a number of reasons, is not only an attempt to set up channels to exchange vital information, but also an exercise in setting the standards under which further cooperation will be forged.

This timely work seeks to identify the differences between the domestic procedural rules and principles of an array of EU and non-EU countries and analyse them in the context of European Union law requirements. Specific attention is paid to the impact of State aid rules on procedural law in tax matters, on constitutional law requirements as well as tax treaty law issues. Since customs law is already harmonized in the form of the Community Customs Code, it serves as a starting point to examine the extent to which harmonized procedural law is possible. South Africa, the power house of the African continent, as well as Germany, Europe’s largest economic power, are faced with an intricate maze of international obligations, whether related to the United Nations, the World Trade Organization, the African Union or the European Union (EU), international human rights law, international humanitarian law, or any other sub-regime of international law. The two countries are in a different position when facing the implementation of this maze of obligations. South Africa is a developing economy that faces various capacity challenges which, at times, also impact the manner and extent to which it implements its international treaty obligations. Germany, ont the other hand, benefits from comparatively well-funded institutes of international law and a well-trained academic community, which have contributed to the successful implementation of much of international law. But as the relevant chapters in this volume show, the German case is not without its own complexities. As a result, an exchange of ideas and experiences pertaining to the implementation of international obligations can prove fruitful for both countries. Moreover, such an exchange could also serve as a useful point of departure for other countries in Southern Africa that face similar challenges in relation to implementation. The current book explores suitable techniques of implementation of international law, by comparing South Africa with Germany. After a general overview of the status of international law within Germany and South Africa respectively, it focuses on the implementation of international instruments pertaining to key sub-areas of international law in the two countries. These include the United Nations Charter (peace and security), the international law of the sea, international economic law, international environmental law, international human rights law, international criminal law, regional integration, and the status of international judicial decisions before domestic courts.
