By any measure, New Zealand must confront monumental issues in the years ahead. From the future of work to climate change, wealth inequality to new populism – these challenges are complex and even unprecedented. Yet why does New Zealand’s political discussion seem so diminished, and our political imagination unequal to the enormity of these issues? And why is this gulf particularly apparent to young New Zealanders? These questions sit at the centre of Max Harris’s ‘New Zealand project’. This book represents, from the perspective of a brilliant young New Zealander, a vision for confronting the challenges ahead. Unashamedly idealistic, The New Zealand Project arrives at a time of global upheaval that demands new conversations about our shared future.

Feminist Judgments Of Aotearoa New Zealand written by Elisabeth McDonald and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-11-30 with Law categories.

This edited collection asks how key New Zealand judgments might read if they were written by a feminist judge. Feminist judging is an emerging critical legal approach that works within the confines of common law legal method to challenge the myth of judicial neutrality and illustrate how the personal experiences and perspectives of judges may influence the reasoning and outcome of their decisions. Uniquely, this book includes a set of cases employing an approach based on mana wahine, the use of Maori values that recognise the complex realities of Maori women's lives. Through these feminist and mana wahine judgments, it opens possibilities of more inclusive judicial decision making for the future. 'This Project stops us in our tracks and asks us: how could things have been different? At key moments in our legal history, what difference would it have made if feminist judges had been at the tiller? By doing so, it raises a host of important questions. What does it take to be a feminist judge? Would we want our judges to be feminists and if so why? Is there a uniquely female perspective to judging?' Professor Claudia Geiringer, Faculty of Law, Victoria University of Wellington 'With this book, some of our leading jurists expose the biases and power structures that underpin legal rules and the interpretation of them. Some also give voice to mana wahine perspectives on and about the law that have become invisible over time, perpetuating the impacts of colonialism and patriarchy combined on Maori women. I hope this book will be a catalyst for our nation to better understand and then seek to ameliorate these impacts.' Dr Claire Charters, Associate Professor, Faculty of Law, University of Auckland 'The work is highly illuminating and is critical to the development of our legal system ... It is crucial, not only for legal education, so that students of the law open their minds to the different ways legal problems can be conceptualised and decided. It is also crucial if we are going to have a truly just legal system where all the different voices and perspectives are fairly heard.' Professor Mark Henaghan, Dean of the Faculty of Law, University of Otago 'I believe this project is particularly important, as few academics or researchers in New Zealand concentrate on judicial method. I am therefore hopeful that it will provoke thoughtful debate in a critical area for society.' The Honourable Justice Helen Winkelmann, New Zealand Court of Appeal

This book offers a unique insight into the key legal and social issues at play in New Zealand today. Tackling the most pressing issues, it tracks the evolution of these societal problems from 1840 to the present day. Issues explored include: illegal drugs; racism; the position of women; the position of Maori and free speech and censorship. Through these issues, the authors track New Zealand's evolution to one of the most famously liberal and tolerant societies in the world.

The Teaching Of Criminal Law written by Kris Gledhill and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-08-19 with Education categories.

The Teaching of Criminal Law provides the first considered discussion of the pedagogy that should inform the teaching of criminal law. It originates from a survey of criminal law courses in different parts of the English-speaking world which showed significant similarity across countries and over time. It also showed that many aspects of substantive law are neglected. This prompted the question of whether any real consideration had been given to criminal law course design. This book seeks to provide a critical mass of thought on how to secure an understanding of substantive criminal law, by examining the course content that best illustrates the thought process of a criminal lawyer, by presenting innovative approaches for securing active learning by students, and by demonstrating how criminal law can secure other worthwhile graduate attributes by introducing wider contexts. This edited collection brings together contributions from academic teachers of criminal law from Australia, New Zealand, the United Kingdom, and Ireland who have considered issues of course design and often implemented them. Together, they examine several innovative approaches to the teaching of criminal law that have been adopted in a number of law schools around the world, both in teaching methodology and substantive content. The authors offer numerous suggestions for the design of a criminal law course that will ensure students gain useful insights into criminal law and its role in society. This book helps fill the gap in research into criminal law pedagogy and demonstrates that there are alternative ways of delivering this core part of the law degree. As such, this book will be of key interest to researchers, academics and lecturers in the fields of criminal law, pedagogy and teaching methods.

In 2008, the Family Law Council was asked by the Attorney-General to provide advice on improving the coordination between the family law and the State and Territory family violence systems, with particular emphasis on court related services. The Council examined how the family law system could better identify and address allegations of family violence and how related authorities could share information and assessments. This report presents their advice, which includes recommendations addressing community education on domestic violence and parenting rights under the law, professional training on assessment and procedures, and interagency collaboration between courts, state and territory child protection agencies, and other related bodies. The report discusses: the impacts of family violence on children and parenting; definitions of family violence; family violence and specific issues, such as health and culture; the role of the Commonwealth Government; the need for a common understanding that is evidence based; the jurisdictional framework impacting on family violence and child abuse; adducing evidence in court; communication between States, Territories and Federal authorities; and a framework for legislative reform.
