Il testo analizza 50 casi concreti – oggetto di ordinanze e sentenze emesse nel corso del 2012 dalla Corte di Cassazione – in materia di tutela del contribuente dall’imposizione dell’IRAP. Ogni caso esposto è comprensivo di un commento, di una scheda di riepilogo, del testo integrale dell’ordinanza o della sentenza (oltre ai riferimenti a tutte le precedenti pronunce che hanno disciplinato analogamente la fattispecie in questione), nonché delle annotazioni al Codice Civile, al Codice di Procedura Civile e al Codice Penale, estremamente utili in sede di contenzioso tributario. I casi trattati riguardano non solo le diverse tipologie di contribuenti, ma anche aspetti pratici sulla debenza del tributo e sulle formalità sostanziali del processo tributario. Vengono inoltre trattate fattispecie di particolare interesse quali: il risarcimento al contribuente per l’eccessiva durata del processo d’appello; il litisconsorzio tra i soci e la società; la regolare costituzione in giudizio dell’Ufficio; l’ammissione del credito IRAP nel passivo fallimentare; l’IRAP ed il rapporto con il diritto penale; l’onere della prova per il contribuente; l’inquadramento del soggetto passivo d’imposta alla luce degli interventi della Cassazione.
