Fino ad alcuni decenni fa, la distinzione tra filosofia del diritto e teoria generale del diritto sembrava consolidata: la prima era ritenuta disciplina filosofica, la seconda disciplina giuridica; la prima disciplina affascinante, ma (almeno per alcuni) inessenziale per la pratica giuridica, la seconda disciplina più arida, ma (almeno per alcuni) utile e significativa per il lavoro del giurista; la prima disciplina orientata ai valori e pertanto ideologica, dai contorni indefinibili e in larga misura arbitrari, la seconda una disciplina orientata ai fatti, alla concretezza del diritto positivo e grazie a questo solido riferimento dotata di una rigorosa identità. Alcuni ancora sostenevano che la filosofia del diritto fosse opportunamente definibile alla stregua di una teoria del diritto fatta da filosofi e la teoria generale del diritto come una filosofia del diritto fatta da giuristi. È ben difficile, oggi, continuare ad elaborare simili dicotomie. La rigidità delle demarcazioni accademiche sembra aver perduto ogni senso. Chi è ottimista parla con soddisfazione della fusione di orizzonti che caratterizza il postmoderno; chi è pessimista ha invece buon gioco nel profetizzare un ulteriore decadimento qualitativo del sapere giuridico del nostro tempo. Chi vuole, invece, andare alle cose stesse non potrà alla fine che arrivare ad una sola conclusione e cioè che quella dimensione del sapere che ha per oggetto il diritto, e cioè il sapere giuridico, non tollera etichettature aprioristiche.
