Offender-focused prosecution concentrates attention to the actions, decisions, choices, and motivations of the offender. This paper describes current innovations developed or used by prosecutors as applied specifically towards domestic violence. Both the increasing demand for a more effective criminal justice system response to domestic violence and the changing role of the prosecutor have fostered the development and implementation of many innovative strategies for dealing with the unique issues and problems related to domestic violence. After discussing the history of domestic violence prosecution and its influence on the changing role of the prosecutor, the paper reviews four general types of initiatives currently employed by prosecutors specific to domestic violence cases. Each is described in terms of its prevalence, advantages, limitations, and relative success. General limitations and constraints inherent to domestic violence, prosecution, and policy evaluation are also discussed. Finally, policy recommendations relative to current research and practice are presented. Given the lack of conclusive research and the variability among jurisdictions, prosecutors must often rely on their own evaluations in measuring the effectiveness of their programs. While most innovations are tested largely only through direct implementation, continued research is certainly warranted, and should be undertaken in conjunction with the most promising practices.

This book argues that past inattentive treatment by state criminal justice agencies in relation to domestic abuse is now being self-consciously reversed by neoliberal governing agendas intent on denouncing crime and holding offenders to account. Criminal prosecutions are key to the UK government’s strategy to end Violence Against Women and Girls. Crown Prosecution Service policy affirms that domestic abuse offences are ‘particularly serious’ and prosecutors are reminded that it will be rare that the ‘public interest’ will not require of such offences through the criminal courts. Seeking to unpick some of the discourses and perspectives that may have contributed to the current prosecutorial commitment, the book considers its emergence within the context of the women’s movement, feminist scholarship and an era of neoliberalism. Three empirical chapters explore the prosecution commitment on the one hand, and the impact on women’s lives on the other. The book’s final substantive chapter offers a distinctive normative conceptual framework through which practitioners may think about women who have experienced domestic abuse that will have both intellectual appeal and practical application.

"Female victims of intimate partner violence are not likely to seek legal help for their victimization despite legislative changes that were implemented to recognize this crime as a serious public issue. Various factors, such as persisting patriarchal ideologies and the victim-offender relationship, keep victims silent and reluctant to seek help from police and prosecutors. This is problematic since reporting rates of intimate partner violence remain low and victim cooperation is necessary for successful prosecution. Based on data from a small, Ontario city, bivariate and multivariate analyses revealed that the victim’s relationship to the offender was significantly associated with legal helpseeking. Specifically, women in intact relationships were less likely than women in estranged relationships to seek legal help, illustrating the philosophical idea that a public/private dichotomy still exists. Additionally, victims were not likely to cooperate with the prosecution if someone else reported their victimization. Whether or not to file domestic violence cases when the victim does not support prosecution is a difficult decision. Previous research provides contradictory evidence regarding the effects on victim safety, empowerment, and official measures of recidivism of prosecuting despite victim opposition, This study compared a jurisdiction that tends not to file cases if the victim opposes prosecution (the Bronx), with a jurisdiction that files all domestic violence cases (Brooklyn). We sampled 272 cases involving intimate partners that were declined for prosecution in the Bronx and 211 cases that were filed in Brooklyn but probably would have been declined in the Bronx. These cases were analyzed in regard to re-arrests using state criminal justice data. We also conducted either in-depth individual or group interviews with a total of 35 victims from the Bronx and Booklyn, and performed a cost analysis of differential resources required by the two policies.
