National Identity In Eu Law written by Elke Cloots and has been published by OUP Oxford this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-02-12 with Law categories.

Despite nearly sixty years of European integration, neither nations nor national loyalties have withered away. On the contrary, national identity rhetoric seems on the rise, not only in politics but also in legal discourse. Lately we have seen a rise in the number of Member States invoking their national identity in an attempt to justify a derogation from a requirement imposed on them by a Treaty article or an EU legislative act, or to legitimize a particular national reading of such an EU norm. Despite this, the European Court of Justice (ECJ) has yet to develop a coherent approach to such arguments, or express a vision of the role national identity should play in EU law. Elke Cloots undertakes this task by providing a principled and coherent scheme for the adjudication of disputes involving claims based on the national identity of a Member State. Should arguments involving national identity be legally relevant? If yes, how should the ECJ approach such identity-related interests? Cloots crafts a normative framework to assist the ECJ in striking the right balance between European integration and respect for the identity concerns at issue. The book combines rigorous theoretical inquiry with thorough analysis of the European Treaties and case law, with particular attention paid to litigation involving domestic measures concerning the national system of government, constitutional rights protections, and language policy. Clarifying the issues at stake and presenting a solution to these problems, this book will be an invaluable resource for the academics, lawyers, and policy makers in the field.

The Public Law Private Law Divide written by Jean-Bernard Auby and has been published by Hart Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006 with Law categories.

The contributions brought together in this book derive from joint seminars held by scholars from the University of Oxford and the University of Paris II. The starting point is the original divergence between two jurisdictions, with the initial rejection of the public-private divide as viewed under English law, while at the same time, the total acceptance as natural in French law. The book then demonstrates that the two systems have convergedâ??the British one towards a certain degree of acceptance of the division and the French one towards a growing questioning of the division. However this is not the only part of the story, since both visions are now commonly colored and affected by European law and by globalization, which introduces new tensions into our legal understanding of what is "public" and what is "private".

The Logic Of Information written by Luciano Floridi and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-01-21 with Mathematics categories.

Luciano Floridi presents an innovative approach to philosophy, conceived as conceptual design. He explores how we make, transform, refine, and improve the objects of our knowledge. His starting point is that reality provides the data, to be understood as constraining affordances, and we transform them into information, like semantic engines. Such transformation or repurposing is not equivalent to portraying, or picturing, or photographing, or photocopying anything. It is more like cooking: the dish does not represent the ingredients, it uses them to make something else out of them, yet the reality of the dish and its properties hugely depend on the reality and the properties of the ingredients. Models are not representations understood as pictures, but interpretations understood as data elaborations, of systems. Thus, he articulates and defends the thesis that knowledge is design and philosophy is the ultimate form of conceptual design. Although entirely independent of Floridi's previous books, The Philosophy of Information (OUP 2011) and The Ethics of Information (OUP 2013), The Logic of Information both complements the existing volumes and presents new work on the foundations of the philosophy of information.

The Invention Of Law In The West written by Aldo Schiavone and has been published by Belknap Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012-01-01 with History categories.

Law is a specific form of social regulation distinct from religion, ethics, and even politics, and endowed with a strong and autonomous rationality. Its invention, a crucial aspect of Western history, took place in ancient Rome. Aldo Schiavone, a world-renowned classicist, reconstructs this development with clear-eyed passion, following its course over the centuries, setting out from the earliest origins and moving up to the threshold of Late Antiquity. The invention of Western law occurred against the backdrop of the Roman Empire's gradual consolidationâe"an age of unprecedented accumulation of power which transformed an archaic predisposition to ritual into an unrivaled technology for the control of human dealings. Schiavone offers us a closely reasoned interpretation that returns us to the primal origins of Western legal machinery and the discourse that was constructed around itâe"formalism, the pretense of neutrality, the relationship with political power. This is a landmark work of scholarship whose influence will be felt by classicists, historians, and legal scholars for decades.

Privacy And Data Protection In Software Services written by Roberto Senigaglia and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-08-05 with Technology & Engineering categories.

The aim of the book is to create a bridge between two ‘lands’ that are usually kept separate: technical tools and legal rules should be bound together for moulding a special ‘toolbox’ to solve present and future issues. The volume is intended to contribute to this ‘toolbox’ in the area of software services, while addressing how to make legal studies work closely with engineers’ and computer scientists’ fields of expertise, who are increasingly involved in tangled choices on daily programming and software development. In this respect, law has not lost its importance and its own categories in the digital world, but as well as any social science needs to experience a new realistic approach amid technological development and individuals’ fundamental rights and freedoms.

Belated Feudalism written by Karen Orren and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1991 with History categories.

Traditional theories of American political development depict the American state as a thoroughly liberal state from its very inception. In this book, first published in 1992, Karen Orren challenges that account by arguing that a remnant of ancient feudalism was, in fact, embedded in the American governmental system, in the form of the law of master and servant, and persisted until well into the twentieth century. The law of master and servant was, she reveals, incorporated in the US Constitution and administered from democratic politics. The fully legislative polity that defines the modern liberal state was achieved in America, Orren argues, only through the initiatives of the labor movement in the late nineteenth and early twentieth centuries, and was finally ushered in as part of the processes of collective bargaining instituted by the New Deal. This book represents a fundamental reinterpretation of constitutional change in the United States and of the role of American organized labor, which is shown to be a creator of liberalism, rather than a spoiler of socialism.

Rome In The Age Of Enlightenment written by Hanns Gross and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2004-04-22 with History categories.

This is the only scholarly work in the English language on the city of Rome in the Age of the Enlightenment, and the only book in any language to treat this fascinating city in all its multifarious aspects. Professor Gross combines extensive archival research with the latest findings of other scholars to produce a uniquely rounded portrait of the papal capital, elegantly illustrated with contemporary engravings by Piranesi and others. The book is divided into two sections, in the first of which Professor Gross discusses the material and institutional structures of the city, including its demography, economy, food supply, and judicial systems. The second section considers aspects of intellectual, cultural, and artistic life. Professor Gross contends not only that ancien-regime Rome witnessed a decline in Counter-Reformation fervour, but that this decay resulted in a marked dissonance in the political, social, and cultural life of the city.
