Traditional theory of Islamic Law recognizes four sources of Sharia: the Quran, sunnah (authentic hadith), qiyas (analogical reasoning), and ijma (juridical consensus). Four Sunni Madhhab (legal school of Sunni Islam), Hanafi, Maliki, Shafiʽi, Hanbali and Zahiri, developed Sunni methodologies for deriving Sharia rulings from scriptural sources using a process known as ijtihad. Traditional jurisprudence (fiqh) distinguishes two principal branches of law, ʿibādāt (rituals) and muʿāmalāt (social relations), which together comprise a wide range of topics. Its rulings are concerned with ethical standards as much as with legal norms, assigning actions to one of five categories: mandatory, recommended, neutral, abhorred, and prohibited. Fiqh was elaborated over the centuries by legal opinions (fatwas) issued by qualified jurists (muftis) and historically applied in Sharia courts by ruler-appointed judges, complemented by various economic, criminal and administrative laws issued by Muslim rulers. The result of legal thought is the production of legal documents based on the requirements of the community. In Indonesia, Islamic law grows and evolves in the form of four products of legal thought: fiqh, ulama fatwas, court rulings (jurisprudence), and laws. In Indonesia, the four products of legal thinking serve as rules for Muslims in national, state, and social life.

The book is an interdisciplinary study on the relationship between Muslims and their mosques in Indonesia and Malaysia. It presents selected historic mosques that demonstrate local interpretations and sociocultural assimilation, as well as a geographical syncretism, of Islam in local societies. The book unveils the contestations, synchronizations, assimilations, and integrations of local and foreign elements into the contextual architecture and sociologically institutionalized system that is the mosque: the Islamic place of worship. The author excavates the mosque’s historical origins and traces the iconic elements, features, and designs from their earliest historical settings and contexts. He then identifies, analyzes, and theorizes the outcomes of the interaction between Islam and local traditions through Malaysian and Indonesian case studies. The book proposes that Islam, at its philosophical level, can be culturally acceptable anywhere because it contains universal virtues of humanity for equality, fraternity, and social justice. The book unfolds how a dialectical contestation and acculturation of Dutch colonialism, Middle Eastern elements of culture, and local customs and traditions, might then come into dialogue, peacefully. Finally, the book considers the relationship between Malay and Indonesian architecture within their respective political cultures, shedding light on Islam and its practice within rich multicultural contexts. Exploring the distinctive nature and role of local pilgrimage traditions among Muslims and Catholics, Muslim and Catholic Pilgrimage Practices draws particularly on south central Java, Indonesia. In this area, the hybrid local Muslim pilgrimage culture is shaped by traditional Islam, the Javano-Islamic sultanates, and the Javanese culture with its strong Hindu-Buddhist heritage. This region is also home to a vibrant Catholic community whose identity formation has occurred in a way that involves complex engagements with Islam as well as Javanese culture. In this respect, local pilgrimage tradition presents itself as a rich milieu in which these complex engagements have been taking place between Islam, Catholicism, and Javanese culture. Employing a comparative theological and phenomenological analysis, this book reveals the deeper religio-cultural and theological import of pilgrimage practice in the identity formation and interaction among Muslims and Catholics in south central Java. In a wider context, it also sheds light on the larger dynamics of the complex encounter between Islam, Christianity and local cultures.
