No se puede negar que existen magníficos artículos esparcidos o libros que trataron de la repercusión económica del Derecho Tributario, pero no cuentan con la sistematización, la amplitud de tratamiento y los avances teóricos que este contempla. Vimos surgir, a partir de Ronald Coase, y, en los días actuales, con Richard Posner, James Buchanan, Mises o Douglass North, estudios relevantes sobre diversos segmentos del Derecho, pero siempre parciales y nunca dedicados integralmente al sector de la tributación. Esta laguna, aquí y en otros lugares, se encuentra superada. Se advierte que esta no es una teoría de la “interpretación económica del Derecho Tributario”, como muchos puedan suponer. Por el contrario, el propio autor resalta que no se puede aceptar la interpretación económica en el Derecho Tributario, puesto que viola los sentidos mínimos del sistema tributario y sustituye la noción de justicia fiscal por la de la eficiencia recaudatoria. El libro trata sobre las principales cuestiones teóricas y prácticas que serán examinadas con una minuciosa aplicación al campo del Derecho Tributario. De esta forma, se estudia el teorema de Coase para analizar la tributación como costo de transacción; Buchanan, para poder explicar la tributación como elección pública (Public Choice); la escuela austriaca, a la luz de la teoría de la tributación como “robo”; Richard Posner, para exponer la relación entre la tributación y la maximización de la riqueza; la Nueva Economía Institucional (NEI), que entiende la tributación como institución; y la teoría de los juegos estudia la tributación como una acción coordinada o no coordinada de los agentes económicos.
