Excerpt from Das Kirchenrecht der Katholiken und Protestanten in Deutschland Von einer dem Rahmen dieses Handbuches angepassten Darstellung der Ketzer Inquisition und der Hexenverfolgung, soweit bei der letzteren die Kirche und ihre Organe thatig gewesen sind, konnte um so weniger abgesehen werden als beide Erscheinungen, welche in neuerer Zeit gerade seitens der Kirchenrechtswissenscbaft eine geringe Berucksichtigung erfahren haben, wesentlich mit fiir die Beurtheilung des Charakters des kirchlichen Straf rechtes und des kirchlichen Strafverfahrens' in Betracht kommen. Bei der Behandlung der ersteren durfte endlich die Spanische Inquisition nicht uber gangen werden. Auch in Betreff ihrer fehlt es an einer Darlegung ihrer rechtlichen Organisation, und nur durch eine solche lasst sich ihr Verhalt niss zur allgemeinen Inquisifion mit Sicherheit bestimmen, und die noch immer bestehende Streitfrage, ob sie eine kirchliche oder staatliche Institution gewesen ist, zur Losung bringen.
