Dieses Buch befasst sich mit der Auftraggeberhaftung nach § 14 des Arbeitnehmer-Entsendegesetzes und § 13 des Mindestlohngesetzes. Der Autor untersucht die Voraussetzungen und Rechtsfolgen der Auftraggeberhaftung sowie deren prozessuale Durchsetzung. In § 14 Satz 1 AEntG – auf den § 13 MiLoG verweist – hat der Gesetzgeber dabei auf Rechtsfolgenseite angeordnet, dass der Auftraggeber „wie ein Bürge“ haften soll. Das wirft die Frage auf, wie diese Haftung rechtlich einzuordnen ist. Im Zentrum des Buches wird daher die Rechtsnatur der Auftraggeberhaftung untersucht. Nach der Darstellung, in welcher Form die Auftraggeberhaftung auf die Bürgschaft des Bürgerlichen Gesetzbuches Bezug nimmt und in das System der Bürgenhaftung einzuordnen ist, zeigt der Autor, inwiefern die Normen des Bürgschaftsrechts auf die Auftraggeberhaftung Anwendung finden.

This book traces the origins of the German welfare state. The author, formerly director at the Max-Planck-Institute for European Legal History, Frankfurt, provides a perceptive overview of the history of social security and social welfare in Germany from early modern times to the end of World War II, including Bismarck’s pioneering introduction of social insurance in the 1880s. The author unravels “layers” of social security that have piled up in the course of history and, so he argues, still linger in the present-day welfare state. The account begins with the first efforts by public authorities to regulate poverty and then proceeds to the “social question” that arose during the 19th-century Industrial Revolution. World War I had a major impact on the development of social security, both during the war and after, through the exigencies of the war economy, inflation and unemployment. The ruptures as well as the continuities of social policy under National Socialism and World War II are also investigated.

This book deals with the rules that are in force in Europe for juvenile offenders. The aim of the rules is to uphold the rights and safety of juvenile offenders subject to sanctions or measures and to promote their physical, mental and social well-being when subject to community sanctions or measures, or any form of deprivation of liberty. It is based on Recommendation Rec(2008)11 of the Committee of Ministers of the Council of Europe on the European Rules for juvenile offenders subject to sanctions or measures, which was adopted on 5 November 2008. The first part of the book contains the text of the recommendation and is followed by a commentary which explains in finer detail the rules and the points raised by the text. The final section provides an analysis of the national replies to a questionnaire related to the treatment of juvenile offenders. This work will be of interest to human rights scholars, researchers and students of law, criminology and international relations.
