Millions of fed. taxpayers receive billions of dollars in income tax refunds every year. Many of these refunds are paid to taxpayers who owe money to the fed. gov¿t. or to their state or local gov¿t. The law allows certain types of debts to be collected through offsets of fed. income tax refunds before payments are issued to taxpayers -- in calendar year 2008, over $5 billion was deducted from income tax refunds and used instead to pay other fed. agency non-tax debt, state income tax debt, and overdue child support payments. This report describes: (1) recent proposals to expand the refund offset program; and (2) challenges and design issues that would need to be addressed in the event of program expansion. An Overview of the Treasury Offset and Federal Payment Levy Programs Summary One of the numerous functions performed by the Financial Management Service (FMS) at the Treasury Department is the collection of delinquent tax and non-tax debt owed to a variety of state governments and federal agencies. [...] Among the offsets included in the bill is an amendment of IRC Section 6331(h)(2) that would allow the FMS to apply a continuous levy to federal payments to vendors that sell or rent property to the federal government and are delinquent in the payment of their federal taxes. [...] Before the passage of TRA97, the IRS lacked the authority to create an automated process for identifying taxpayers with delinquent tax debt who receive federal payments and levying those payments.2 The FPLP facilitates the collection of overdue federal taxes by imposing a continuous levy on designated federal payments disbursed by the FMS to business and individual taxpayers holding delinquent tax [...] Whenever a payment is levied, the FMS sends a letter to the taxpayer explaining which payment was reduced and by how much, and advising the taxpayer to contact the IRS to resolve the matter. [...] The Internal Revenue Service Restructuring and Reform Act of 1998 enlarged the scope of the TOP when it authorized the collection of state tax debt through the offset of federal income tax refunds.
