Alla base del presente volume sta una domanda semplice, che ha a che fare con il modo in cui i filosofi del diritto e i giuristi in genere pensano e praticano la propria disciplina. La domanda è relativa al ‘se’, al ‘quanto’, e al ‘verso che cosa’ questo modo debba essere aperto e debba perciò dialogare con altri saperi, intendendo con questi ultimi sia le altre scienze giuridiche, sia altre sfere di conoscenza, che oggi più che mai interrogano il diritto e di conseguenza coloro che lo praticano anche a livello teorico e scientifico. Questa apertura si porta dietro il tema della responsabilità del giurista, che proprio in virtù della sua collocazione nel mondo non può chiudersi nel luogo protetto della sua professionalità tecnicizzata ma deve compiere scelte che chiamano in causa continuamente la sua personalità e i suoi valori. È infatti in gioco una questione cruciale, in senso lato politica: quella del ruolo che la cultura giuridica occupa sulla scena pubblica. Quanto più ci si rende conto della vastità dei problemi (di portata globale) che nella realtà contemporanea ci troviamo ad affrontare – impatto delle nuove tecnologie, pandemia, guerre e conflitti di varia natura –, nei quali il ruolo della cultura giuridica nel dibattito pubblico sembra ridotto al minimo, tanto più appare urgente e auspicabile quell’allargamento dell’orizzonte che deve accompagnare il ‘ritorno’ del giurista nel mondo.
