El sector de la Hostelería presenta un importante peso en la economía, tanto española como en el ámbito de la Comunidad Valenciana, y ello, tanto en términos estrictamente económicos como de empleo generado, merced a su integración en el más amplio sector (en sentido lato) del Turismo, verdadero «motor» productivo en España, en épocas de crecimiento y, también, de crisis. No puede obviarse, además, que la Hostelería se caracteriza por ser un sector productivo significativa y tradicionalmente vinculado a exigencias estacionales, lo que implica la existencia de «picos productivos», con requerimientos extraordinarios de fuerza de trabajo que se satisfacen, por lo general, mediante el recurso a la contratación temporal. Y es que, por lo que hace al empleo, el sector hostelero (tanto en el ámbito estatal, como en la Comunidad Valenciana) sigue un patrón de abrumadora temporalidad, con índices iguales o superiores al 40% en la práctica totalidad de las empresas; estas cifras contrastan, desde luego, con las exigencias de «estabilidad y seguridad del trabajo» referidas por la OIT en el concepto de trabajo decente, y difícilmente se concilian con la sostenibilidad social exigible en el marco de un modelo social de Estado como el español.

The economic crisis has highlighted major shortcomings in the EU flexicurity strategy which, although suitable to tackle structural unemployment in a period of economic growth, it proved unable to stand the impact of the recession, which requires specific measures to maintain employment. Against this background, the authors of the present papers, which were presented at the International Scientific Conference “Labour Market of the 21st Century: Looking for Flexibility and Security”, on the occasion of the 370th Anniversary of the establishment of Vilnius University’s Faculty of Law, that took place on 12–14 May 2011, investigate the development of labour regulation in the 21st century, with particular reference to the relation between flexibility and security and to the need to strike a balance between these two elements. In any country where there is a Bill of Rights, constitutional rights reasoning is an important part of the legal process. Examining the practice in other jurisdictions can be a valuable guide. Robert Alexy's classic work reconstructs the reasoning behind the jurisprudence of the German Basic Law and in doing so provides a theory of general application to all jurisdictions where judges wrestle with rights adjudication. In considering the features of constitutional rights reasoning, the author moves from the doctrine of proportionality, procedural rights and the structure and scope of constitutional rights, to general rights of liberty and equality and the problem of horizontal effect.
