All rights not granted by the above license are retained by the author. Abstract: Home ownership is a dream for many Hong Kong people. In 1997, property prices in Hong Kong soared to a new height. To meet the community's expectation, The HK SAR Government launched which believed Tenants Purchase Scheme (TPS) was a solution. Through this scheme, public housing tenants were encouraged to buy their flats in their affording price. In the beginning, it received a very good response and it seemed very optimistic. However, it was severely criticized lately about the estate management and the arguments arc never ended. According to Arnstein's model, the cause might be due to different expectations, role change and participation from various involved parties, including Housing Authority, TPS flat owners and public housing tenants in the TPS estates. Cairneross, Clapham and Goodlad (1997) implied tenant, housing manager and councilor were playing a game under the framework of tenant participation and such game determinate the rules of housing management. Thus, that may apply to the situation happened in TPS. With the vision of living in peace and contentment for TPS residents, this dissertation aims at examining the role changing of residents, from tenant to owner, and the level of resident participation in those TPS estates and eventually to exam how these conflicts occur from such changes. By applying Arnstein's model to investigate the issue, we hope to identify the root cause and provide a light of resolution. To carry out the investigation, documentary review and interviews were conducted to gather information for analysis. Base on the findings with Arnstein's model, this paper concludes that TPS could be a good example to explain Arnstein's ladder of Citizen Participation - The change of role leads to the reallocation of estate management authority. If we can solve the management issues, TPS is a good scheme to help citizens to create comfortable living place. We hope this dissertation can help to provide a light of resolution. Submitted by James SZE Wang-cho (University No. 1990156916) for the degree of Master of Science (Interdisciplinary Design and Management) at The University of Hong Kong in August 2005. Abstract Hong Kong is well-known as a bastion of free market, private enterprise and limited Government, in its land and housing policies. Being the largest land owner and biggest housing unit supplier in the past several decades, the Hong Kong Government is playing an important role towards sustainable housing development. Although the Government always claimed that it pursues a positive non-intervention policy, inevitably it promotes housing policies from time to time, such as the Tenant Purchasing Scheme (TPS), which might have drastic influences on the housing development and may affect the sustainability of Hong Kong society as a whole. In his first policy address, the Chief Executive Tung Chee-hwa made a bold attempt in changing the housing policy to promote home ownership for the well being of the people and maintain the social stability. One of the policies announced following his speech is the Tenant Purchasing Scheme (TPS). The scheme offers the sitting tenants the opportunity to buy their flats at 12% of the estimated full market value. The property market had slumped after the release of the related policy. If the TPS promoted by the Government have played an important role in reducing the existing housing unit transactions and home prices, the TPS can be demonstrated to lead to erosion of wealth and economic inefficiency in the short-term situation. However, the TPS not necessarily failed to fulfill the criteria of sustainable housing development in a long-term situation, namely social, cultural, economic and environmental sustainability. Should this can be proven, the TPS can be considered as a right model to attain sustainable housing development through privatization of the public housing in Hong Kong. Singapore has implemented a similar TPS Scheme for more than 40 years and it is reported that the scheme has succeeded in achieving a sustainable community. Due to their similarity in many aspects as cities, Singaporean's approach towards privatization of public housing will be explored and compared to test if TPS is an appropriate model towards sustainable housing development. Being one of the major models of privatizing the public rental housing, if the relative success and failures of Hong Kong's TPS implementation, both in its content and application, can be demonstrated and measured, its future potential effectiveness in achievable a sustained housing development can also be demonstrated. For a number of years, the federal government and various local jurisdictions have struggled with the most effective means of producing more units of affordable housing. This article proposes an affordable housing production model that enables tenants to purchase their single-family homes and multifamily apartment buildings based on a tenant purchasing program prevalent in Washington, D.C. Throughout the years, Washington, D.C., like many jurisdictions, has tried various measures to create and preserve affordable housing and make homeownership affordable to more residents. One of the most productive programs created to produce and preserve units of affordable housing in Washington, D.C. is the program known as the Tenant Opportunity to Purchase Act (TOPA). Generally, TOPA requires that a landlord owning residential property in Washington, D.C. must first offer the tenants residing in that property the opportunity to purchase it before selling that property to a third-party. The tenants then have the right to: (i) maintain the property as a rental owned by either the tenants or a private developer chosen by the tenants, (ii) purchase the property and convert it to a market rate or affordable condominium or cooperative, (iii) sell their rights to purchase the property to any entity the tenants choose for any value negotiated by the tenants, or (iv) ignore their TOPA rights altogether. TOPA helps prevent the loss of affordable housing units to the private market, promotes resident engagement and control in the development of the resident's neighborhood, promotes private investment in preserving affordable housing, enables residents -- specifically low- and moderate-income residents -- to participate in the wealth creation from the property sale, and creates homeownership opportunities for low- and moderate-income residents who might otherwise be priced out of an expensive real estate market. I represented tenant groups in Washington, D.C. in the purchase, renovation, and conversion of their multi-family apartment buildings for many years and experienced TOPA's ability to facilitate the preservation of affordable homeownership in gentrifying neighborhoods, to empower low- and moderate-income residents in influencing the redevelopment of their neighborhoods, and to provide wealth creation for the tenants who were able to successfully purchase their properties in a manner that preserved affordability. Other jurisdictions should consider a law providing some form of tenant purchase rights to residents of multi-family properties to help create and preserve affordable housing. This article seeks to provide those jurisdictions with an in-depth review of TOPA, its benefits, and some suggested areas of improvement. This article also seeks to provide Washington, D.C. with a rare scholarly review of TOPA by someone who worked closely on TOPA policy, business, and legal issues for a number of years.
