El presente trabajo de investigación reviste capital importancia debido a la actualidad de la problemática planteada, en tiempo y espacio; pero sobre todo porque a través del mismo se pretende vislumbrar la disyuntiva acerca de si las leyes de amnistía son una necesidad como instrumentos de apoyo para poner fin a los conflictos armados internos, o si son un medio de impunidad del que hacen uso los actores del conflicto para sustraerse de la responsabilidad sobre violaciones de derechos humanos en contra de la población civil. En este trabajo se pretende hacer un enfoque de las amnistías desde los puntos de vista jurídico y político, de la experiencia salvadoreña, que sirva de aporte a los esfuerzos de la sociedad colombiana ante un eventual proceso de paz que necesariamente habrá de hacer uso de instrumentos iuspolíticos como lo es la amnistía, a fin de buscar la reconciliación de la sociedad. De acuerdo con las circunstancias del momento, la referida amnistía podrá darse de manera sinalagmática o unilateral, pero en todo caso deberá contar con el beneplácito de la sociedad.
