"Analizar el Derecho Internacional Tributario a la luz de las categorías del constructivismo lógico-semántico y de la Teoría de los Sistemas de Niklas Luhmann es el desafío que Jonathan Vita enfrenta al escribir este libro. Ambas propuestas están fundamentadas en bases filosóficas definidas, muy distintas en sus concepciones, pero compatibles si la perspectiva del autor se atuviera, como de hecho se atiene, a determinados puntos que muestren, desde luego, el perfecto cuidado de los objetivos de cada una. El constructivismo es, en primer lugar, un método de trabajo, una forma de componer el discurso preservando la integridad sintáctica del texto, al mismo tiempo en que mejora su dimensión semántica mediante especificaciones de sentido exigidas en la progresión del mensaje. Y nada de esto se obtiene, claro está, sin la adecuada consideración de los efectos pragmáticos pretendidos por el emisor con la emisión del acto del habla. Por el contrario, Luhmann ofrece una visión grandiosa del tejido social como un todo, acentuando la relación entre los distintos subsistemas en un intercambio comunicacional dinámico y permanente. Ahora bien, en el ámbito de los amplios horizontes de la autopoiesis, lo suficiente para comprender la magnitud del conjunto, no se esperaría que dichas teorías pudiesen quedar meramente yuxtapuestas, al punto de operar en función de complemento. Por consiguiente, aquí reside el mérito de Jonathan: reconoce, en el espacio de las dos proyecciones teoréticas, cuáles son los puntos que admiten la conjugación de las materias en un, por así decir, corredor de intersección en el curso del cual podría fluir el diálogo, establecerse la conversación. Dicha maniobra epistemológica ya viene siendo objeto de especulación, por ejemplo, en la consistente obra de Celso Campilongo, comprendiendo los pensamientos de Luhmann y de Kelsen, en un trabajo cuidadoso que requiere la insistente vigilancia del autor para evitar el castigo del sincretismo vulgar". "Ha parecido imposible, en especial, trazar una distinción suficiente entre el Derecho y las otras reglas de conducta humana sin subrayar el lazo esencial que une las dos nociones de derecho y de sociedad: el Derecho es una regla social. Esto no quiere decir que no podría haber Derecho fuera del Estado, y a fortiori fuera de la ley. El Estado, en el sentido de sociedad civil, no es la única sociedad. Pero en la esfera temporal es la sociedad suprema, y su regla es la regla suprema. Tampoco quiere decir esto que se niegue el concepto de un derecho internacional; pero debe pensarse que no habrá un derecho internacional, en el verdadero y pleno significado de la palabra «Derecho», en tanto que no exista una sociedad internacional, más o menos universal, orgánicamente constituida. Por otra parte, se ha querido examinar con más detenimiento —a fin de eliminar equívocos que renacen sin cesar— las relaciones entre la noción de Derecho y las nociones de derecho natural y de justicia. Demasiado a menudo se confunden los planos y los puntos de vista. Y se comete un error al colocar el orden jurídico positivo, o la ley civil (como se designa aquí el Derecho) como prolongación directa y exclusiva del derecho natural y de la justicia". Jean Dabin.

I. The importance of legal questions related to the sea is obvious to everyone. It is hardly surprising that the subjects that make up international current events illustrate the leading role played by maritime affairs. Indeed, it is no coincidence that three quarters of the earth's surface is covered by oceans. Territorial seas, exclusive economic zones, exploitation of the seabed, fishing, transport, insurance, collision, and pollution raise many unresolved questions. On the other hand, the contrast of this importance with the modest attention that existing periodical publications merit must be underscored. Without undervaluing these publications, there has been a need for some time to create a vehicle of common expression, based on three central tenets: interdisciplinary framework, tendency towards uniform law, and both a theoretical and practical approach. a. A framework of interdisciplinary nature seems to be relevant as it is desirable to overcome the artificial separation between public and private law.

PRESENTACIÓN Se puede decir que a José Luis Goñi le conocen todos o casi todos los abogados marítimos y muchos otros profesionales del sector marítimo, por lo que no es necesario extenderse en su presentación. Por eso mismo, tampoco es necesario profundizar en su enorme valía como excelente jurista, como brillantísimo abogado, como árbitro o como profesor, ni en los numerosos logros profesionales que tuvo en todas las facetas que tuvieran que ver con el Derecho, ni incluso en su notable presencia en las instituciones más representativas del mundo del Derecho Marítimo. Dedicado al Derecho Marítimo y del transporte desde el año 1959 sin interrupción y con exclusividad, siendo pionero en España en este campo, en 1964 fundó su propia firma, Goñi & Co., donde además de ejercer como abogado formó a grandes profesionales del sector. Participó en asuntos de gran calado como "Urquiola", "Mar Egeo", "Prestige", "Yak-42", "Oddysey", etc., y actuó como árbitro en numerosos arbitrajes tanto institucionales (Cámara de Comercio Internacional, Corte Española de Arbitraje, Corte de Arbitraje de la Cámara de Comercio de Madrid) como arbitrajes ad hoc. Compaginó el ejercicio de la abogacía con una notable participación en las instituciones marítimas más destacadas, siendo Presidente de la Asociación Española de Derecho Marítimo, Fundador en 1992 del Instituto Iberoamericano de Derecho Marítimo, miembro del Executive Council del Comité Marítimo Internacional, con sede en Amberes, durante seis años, en el que también fue miembro titular; miembro de la Junta Directiva de ASESMAR (Asociación de Estudios del Mar), de la Corte Española de Arbitraje del Consejo Superior de Cámaras de Comercio, Industria y Navegación de España, miembro correspondiente español de la Academia de Jurisprudencia de Buenos Aires y miembro de la Junta de Gobierno de la Asociación de Amigos de la Residencia de Estudiantes. También formó parte de la delegación gubernamental española en numerosas reuniones de organismos de Naciones Unidas sobre trabajos preparatorios de Convenios internacionales marítimos, de transportes, y sobre jurisdicción y arbitraje (IMO, UNCTAD, UNCITRAL). Destacó como ponente en una lista innumerable de foros nacionales e internacionales sobre temas de Derecho Marítimo y arbitraje
