The Unwritten Brazilian Constitution offers an unexplored topic outside Portuguese language: the leading cases on human rights in the Brazilian Supreme Court (Supremo Tribunal Federal – STF). The Brazilian Constitution of 1988 represents an institutional framework able to restructure the relationship between the powers after the military dictatorship. The constituents drafted the Brazilian Constitution in order to set an extensive system of judicial protection for fundamental rights, by means of several instruments that have strengthened access to the Judiciary. Because the Brazilian Constitution has an extensive list of fundamental rights, the STF was called to interpret them several times and it developed an unwritten understanding of these fundamental rights. These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.

This book provides a detailed examination of the historical roots of psychoanalysis from ancient Greece to the late nineteenth century, focusing on social practices that were related to the founders of psychoanalytic theory and maintained within contemporary treatment. Alongside the reconstruction of an evolutionary accumulation of healing practices, the book includes linked discussions of current issues pertaining to psychoanalytic treatment and its working structure as elaborated by Freud and Lacan. There are vital political consequences for psychoanalytic practice - here articulated with an acknowledgement of these practical derivations of early pre-psychoanalytic treatments of the soul. The book demonstrates that these are neither mere techniques nor concepts of the world and the human subject, but they concern the way the problem of power is articulated. The historical establishment of psychoanalytical practice becomes legible through analysis of the traces of the elements of a political ontology, an account of the roots of those traces and the elaboration of the conceptual structure of psychoanalysis as theory and treatment, a praxis which maintains its own distinctive identity.

W. F. Hegel, obra publicada inicialmente em 1807. Por ocasião deste congresso, a comunidade filosófica portuguesa teve a grata oportunidade de se confrontar com algumas das mais recentes orientações de análise da obra do filósofo, pondo-se a si mesma à prova quanto às suas aptidões analíticas. Aqui se deixa o retrato de um tal encontro, tanto quanto possível fiel ao que foram, na altura, as exposições dos diferentes autores. In conjunction with a broad commemorative movement in Europe and America, the Institute for Philosophical Studies, based at the Faculty of Letters, University of Coimbra, in collaboration with the R&D unit L.I.F. – Language, Interpretation and Philosophy and with the “Centre for Philosophy” of the University of Lisbon organized on 19th and 20th November 2007 an international conference commemorating the 200th anniversary of Hegel’s Phenomenology of Spirit (first published in 1807). This book results from the IV International Seminar on Research on Mediatization and Social Processes held in 2020/2021. The III International Seminar on Research on Mediatization and Social Processes had a program developed on two levels: debate panels with invited researchers (5 panels, with the participation of researchers from Sweden(2), Argentina (2), and Brazil (9, including five from PPGCC-Unisinos). In this IV Seminar, the theme of the panels was “Mediatized Sapiens: the social construction of knowledge among interactions, means, circulation, and social mediation.” With mediatized sapiens, we want to refer to several media processes related to the mental changes of the species. Several questions can be enunciated related to these. How can we think of knowledge social construction when mediated by the media processes? To what extent does the mental experience of the species hold media processes as references to its building and inferences? How do the actors in a network participate in these processes? To what extent do institutions and organizations adapt to these new environments? In particular, how do the University, research, and scientific fields participate in this repair? Do the media in digital media, in action through expert systems and artificial intelligence, interpose themselves in these processes to the point of asking incisive and secondary questions? How do temporalities and spatiality affect the conditions of production and reception, including social practices, in the social production of knowledge? What epistemologies and methodologies can account for this new complexity amid indetermination and uncertainty zones?

This book examines the subject of constitutional unamendability from comparative, doctrinal, empirical, historical, political and theoretical perspectives. It explores and evaluates the legitimacy of unamendability in the various forms that exist in constitutional democracies. Modern constitutionalism has given rise to a paradox: can a constitutional amendment be unconstitutional? Today it is normatively contested but descriptively undeniable that a constitutional amendment—one that respects the formal procedures of textual alteration laid down in the constitutional text—may be invalidated for violating either a written or unwritten constitutional norm. This phenomenon of an unconstitutional constitutional amendment traces its political foundations to France and the United States, its doctrinal origins to Germany, and it has migrated in some form to all corners of the democratic world. One can trace this paradox to the concept of constitutional unamendability. Constitutional unamendability can be understood as a formally entrenched provision(s) or an informally entrenched norm that prohibits an alteration or violation of that provision or norm. An unamendable constitutional provision is impervious to formal amendment, even with supermajority or even unanimous agreement from the political actors whose consent is required to alter the constitutional text. Whether or not it is enforced, and also by whom, this prohibition raises fundamental questions implicating sovereignty, legitimacy, democracy and the rule of law.
