Quels ont t les apports du marxisme et de la thorie de Pasukanis la philosophie du droit? Si Pasukanis et sa thorie ont obtenu une place topique autant dans l'histoire de la philosophie du droit que dans la philosophie politique du droit, ou encore dans la thorie conomique du droit, la thorie critique du droit, etc., il faut s'interroger et l'analyser avec un esprit critique. Constatons que son livre emblmatique, La thorie gnrale du droit et du marxisme (1924), continue toujours de susciter des dbats et des controverses, voire mme de l'admiration et des loges. C'est sur ces questions que se penche dans cet ouvrage, le professeur Bjarne Melkevik de l'Universit de Laval. Il les replace dans son contexte gographique: l'ex-Urss, politique: le communisme, et humain: l'esprit rvolutionnaire, la dissidence, l'oppression, la perscution et le fanatisme. L'auteur scrute les sources idologiques et les uvres auxquelles a puis Pasukanis, pour les critiquer ou pour s'en servir afin d'appuyer sa propre lecture du marxisme. Il s'agit de Marx videmment, mais aussi d'Engels, Lnine, Staline. De tous ces crits, qui pendant cette priode tourmente ont trait de l'ternel conflit entre proltariat et bourgeoisie, entre capitalisme et communisme, entre idal dmocratique et toute puissance tatique, la modernit juridique peut-elle garder quelque chose pour la construction de la philosophie du droit? Plus prcisment, l'idologie socialiste de ce penseur de l'ex-Urss qu'tait Pasukanis, a-t-elle apport une contribution significative la philosophie du droit, au positivisme juridique ou au sociologisme juridique? Bjarne Melkevik, docteur s droit de Paris II, est professeur titulaire la Facult de droit de l'Universit Laval (Qubec) et professeur associ au Dpartement de droit et Justice, Universit Laurentienne (Ontario).
