The Problem of the State provides a new perspective on what the social and political sciences can contribute to understandings of the state and the ambivalent place it occupies in our collective affairs. Distinguishing two broad conceptual and methodological approaches to addressing the problem of how to study the state empirically rather than theoretically - the constitutionalist and constructionist positions – the author reviews the grounds and limits of both to reveal their common assumption: that it is up to the social and political sciences to define what the problem of the state is. Building on insights from Marx, Wittgenstein and Ethnomethodology, this book frees the study of the state from the limiting assumptions of common approaches and advocates a return of the problem to its proper environment, in social and political practice.

The topic of “evil” means different things depending upon context. For some, it is an archaic term, while others view it as a central problem of ethics, psychology, or politics. Coupled with state power, the problem of evil takes on a special salience for most observers. When governments do evil –in whatever way we define the term – the scale of harm increases, sometimes exponentially. The evils of state violence, then, demand our attention and concern. Yet the linkage of evil with state power does not resolve the underlying question of how to understand the concepts that we invoke when we use the term. Instead, the question becomes what evil means in the context of and in relation to state power. The fifteen essays in this book bring multiple perspectives to bear on the problems of state-sponsored evil and violence, and on the ways in which law enables or responds to them. The early 21st century has presented considerable challenges to the problem-solving capacity of the contemporary state in the industrialised world. Among the many uncertainties, anxieties and tensions, it is, however, the cumulative challenge of fiscal austerity, demographic developments, and climate change that presents the key test for contemporary states. Debates abound regarding the state's ability to address these and other problems given increasingly dispersed forms of governing and institutional vulnerabilities created by politico-administrative and economic decision-making structures. This volume advances these debates, first, by moving towards a cross-sectoral perspective that takes into account the cumulative nature of the contemporary challenge to governance focusing on the key governance areas of infrastructure, sustainability, social welfare, and social integration; second, by considering innovations that have sought to add problem-solving capacity; and third, by exploring the kind of administrative capacities (delivery, regulatory, coordination, and analytical) required to encourage and sustain innovative problem-solving. This edition introduces a framework for understanding the four administrative capacities that are central to any attempt at problem-solving and how they enable the policy instruments of the state to have their intended effect. In the period between 1575 and 1625, civic peace in England, Scotland, and Ireland was persistently threatened by various kinds of religiously inspired violence, involving conspiracies, rebellions, and foreign invasions. Religious divisions divided local communities in all three kingdoms, but they also impacted relations between the nations, and in the broader European continent. The challenges posed by actual or potential religious violence gave rise to complex responses, including efforts to impose religious uniformity through preaching campaigns and regulation of national churches; an expanded use of the press as a medium of religious and political propaganda; improved government surveillance; the selective incarceration of English, Scottish, and Irish Catholics; and a variety of diplomatic and military initiatives, undertaken not only by royal governments but also by private individuals. The result was the development of more robust and resilient, although still vulnerable, states in all three kingdoms and, after the dynastic union of Britain in 1603, an effort to create a single state incorporating all of them. R. Malcolm Smuts traces the story of how this happened by moving beyond frameworks of national and institutional history, to understand the ebb and flow of events and processes of religious and political change across frontiers. The study pays close attention to interactions between the political, cultural, intellectual, ecclesiastical, military, and diplomatic dimensions of its subject. A final chapter explores how and why provisional solutions to the problem of violent, religiously inflected conflict collapsed in the reign of Charles I.
