The pendency of the issue undecided before a Judge shall not necessarily suspend or delay other proceedings before the Register or Court in the case. XII. Accounts for Services (f Register and Marshal. Every Register shall keep an accurate account of his travelling and incidental expenses, and thosa of any clerk or other officer attending him in the perfo mance of his duties in any case or number of cases which may be referred to him; and shall make return of the same under oath, with proper vouchers (when vuuehers can be procured) on the first Tuesday in each month; and the Marshal shall make his return, under oath, of his actual and necessary expenses in the service of every warrant addressed to him, and for custody of property publication of notices, and other services, and other actual and necessary expenses paid by him, wilh vouchers therefor whenever practicable, and also with a statement that the amounts charged by him are just and reasonable. XIII. Marshal as Messenger It shall be the duty of the Marshal as Messenger to take possession of the property of the Bankrupt, and to prepare, within three days from the time of taking such possession, a complete inventory of all the property, and to return it as soon as completed. The time for making the inventory and return may be enlarged, under proper circumstances, by special order of the District Court. He shall also, in case the bankrupt is absent, or cannot be found, prepare a schedule of the names and residences of his creditors, and the amount due to each, from the books or other papers of the bankrupt that may be seized by him under his...

Excerpt from Bankrupt Law of 1867 and Syllabus of Contents: Together With the Rules and Orders, and Forms and Proceedings in Bankruptcy, as Promulgated by the Supreme Court of the United States, With Alphabetical Index Be it enacted by the Senate and House 0 Representatives of the United States of America in Congress assembled, That t e provisions of second clause of the thirty-third section of said act shall not apply to the cases of proceedings in bankmp[t]cy commenced prior to the first day of January, ei hteen hundred and sixty-nine, and the time during which the operation of t e provisions of said clause is ostponed shall be extended until said first day of January, eighteen hun red and sixty-nine. And said clause is hereby so amended as to read as follows: In all proceedings in bankruptcy commenced after the first da of January, eighteen hundred and sixty-nine, no discharge shall be graute to a debtor whose assets shall not be equal to fifty per centum of the claims proved against his estate upon which he shall be liable as the rinci al debtor, unless the assent in writing of a majority in number and valxixe of his creditors to whom he shall have become liable as principal debtor, and who shall have proved their claims, be filed in the case at or before the time of the hearing of the application for discharge. Excerpt: ... meaning of the word "voluntary," and in contemplation of bankru tcy; for both circumstances must occur, Gibbon vs. Phillips, 7 & C., 529; Brown vs. Kempton, 19 L. J., C. P., 169; if, in consequence of the act of the creditor, it is not voluntary, although the creditor may not have power to obtain immediate benefit to himself by taking legal steps, e. g., a surety, or one to whom the debt is due, but not ayable: --Van Casteel vs. Booker, 2 Ex., 691; Mogg vs. Baker, 4 ees & W., 348. The fact of pressure is not suflicient, if the jur believe that it did not cause the transfer, nor, on the other han, does it follow as a matter of law, though it is a strong presumption of fact, that because the first step in the transaction resulting in the preference was taken by the bankru t, that it was therefore voluntary.--Cook vs. Pritchard, 5 Mann. G., 329; Edwards vs. Glyn, 5 J ur., N. S., 1397. This definition of "voluntary" will render all the cases un_der the Insolvent Acts (which almost invariabl use the term " voluntary") applicable.--Doe vs. Gillett, 2 C., M. R., 581; Amell vs. Beau, 8 Bing., 87, 91. The definition iven in that case is a conveyance or gift, made without such valua le consideration as is sufficient to mduce a party acting_ really and bond fide under the influence of such consideration, or made in favor of a particular creditor spontaneously, and without an ressure on his part to obtain it. In Mogg vs. Baker (4 Mees., 348), it was eld, that a conveyance, in pursuance of a bond fide demand, was good; for that pressure, or an apprehension that, by not making the payment, he, the insolvent, would be in a worse condition, was un-necessary; and if there be pressure, it is immaterial that the...
