When did man discover nuclear waste? To answer this question, we first have to ask if nuclear waste really is something that could be called a scientific discovery, such as might deserve a Nobel Prize in physics. In early writings within nuclear energy research radioactive waste appears to be a neglected issue, a story never told. Nuclear waste first seems to appear when a public debate arose about public health risks of nuclear power in the late 1960s and early 70s. In nuclear physics, consensus was established at an early stage about the understanding of the splitting of uranium nuclei. The fission products were identified and their chains of disintegration and radioactivity soon were well established facts among the involved scientists, as was an awareness of the risks, for example the strong radioactivity of strontium and iodine, and the poisonous effects of plutonium. However, the by-products were never, either in part or in total, called or perceived as waste, just as fission by-products. How and where to dispose of the by-products were questions that were never asked by the pioneers of nuclear physics.

"This book demonstrates how feminist analysis can transform law in a field where paternalism, individualism, gender stereotypes, and tensions over the public-private divide shape judicial decisions. Each chapter focuses on a single court decision related to health law. The decisions concern patient autonomy, informed consent, medical and nursing malpractice, the relationships among health care professionals and the institutions where they work, communications between health care providers and the patients they serve, end-of-life care, reproductive health care, biomedical research, ownership of human tissues and cells, the influence of religious directives on health care standards, health care discrimination, equitable access to long-term care in nursing homes, equitable access to community-based alternatives, private health insurance, Medicaid coverage, the Affordable Care Act, and more. Each chapter begins with a commentary from a scholar who puts the case in historical context, summarizes the original opinion, discusses what makes the rewritten opinion feminist, and describes how a feminist approach might have altered subsequent developments in health law. The feminist judgments take the form of rewritten majority opinions, concurrences, and dissents. The opinion authors are scholars who inhabit the role of a judge deciding the case. They rely exclusively on the factual record, precedents, and scientific understanding available at the time of the original decision to show how a judge with a feminist perspective could have adjudicated the matter differently"--

Clinical Negligence claims currently cost the NHS over £2 billion every year. Litigation is time-consuming, expensive and stressful for all involved. For those whose lives have been changed dramatically as a result of negligent medical treatment, bringing a claim may be the only means of obtaining redress for the harm done to them. But the process of litigation can be a bewildering and sometimes hostile experience. For many healthcare professionals the fear of litigation is a real concern and there is deep anxiety that litigation contributes to an unhealthy, even dangerous culture of blame. Clinical Negligence Made Clear: A Guide for Patients and Professionals is an attempt by one the country’s leading clinical negligence practitioners to help all those who might be affected by such cases to understand what is involved and thereby to reduce the cost and emotional impact of clinical negligence litigation. In concise, accessible language Nigel Poole QC charts how clinical negligence has evolved, its place within the justice system and how compensation is assessed explains ten core legal principles of clinical negligence such as the doctor’s duty of care and the standards expected of healthcare professionals sets out how a claim proceeds and what happens before and during a trial focuses on specific common areas of clinical negligence claims such as wrongful birth, delays in cancer treatment and cosmetic surgery looks to the future and asks whether the current system is sustainable The aim is to provide an intelligent but accessible guide for patients, doctors, nurses, therapists, expert witnesses, and healthcare managers so that those caught up in legal proceedings have a realistic view of the impact they will have and a clearer understanding of when a dispute might be best resolved early. No doubt it will also provide a lively introduction to the subject for students, trainees and lawyers looking to move into clinical negligence work.

Revolutionary Sparks written by Margaret A. Blanchard and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1992-05-07 with Political Science categories.

The governmental pledge to the American people is found in the First Amendment: "Congress shall make no law...abridging the freedom of speech, or of the press." Written more than two hundred years ago, these words now protect a wide range of expressive activity. A broad-gauged discussion of freedom of expression in America, this book begins by studying the period after the Civil War and Reconstruction when new and unsettling ideas appeared with great regularity on the American scene. So many of these ideas were floating around during this period that the nation's leaders often joined forces to repress aberrant notions. In response to such suppression, individuals seeking to better their lives through the expression of new ideas began to demand their rights to speak, write, and associate together to advance their points of view. Blanchard traces this contest for control through the Watergate scandal of the 1970s and the Reagan and early Bush administrations. Blanchard presents a lively discussion of freedom of speech ranging from questions of national security to those of public morality, from loyalty during times of national stress to the right to preach on a public street corner. Including examinations of controversies involving the press, the national government, the Supreme Court, and civil liberties and civil rights concerns, Revolutionary Sparks presents a strong case for the right of Americans to speak their minds and to have access to knowledge necessary for informed self-government.

The New Deal established the contours and character of modern American democracy. It created an anchor and a reference point for American liberal politics through the struggles for racial, gender, and economic equality in the five decades that followed it. Indeed, the ways that liberalism has changed in meaning since the New Deal provide a critical prism through which to understand twentieth-century politics. From the consensus liberalism of the war years to the strident liberalism of the sixties to the besieged liberalism of the eighties and through the more recent national debates about welfare reform and Social Security privatization, the prominent historians gathered here explore the convoluted history of the complex legacy of the New Deal and its continuing effect on the present. In its scope and variety of subjects, this book reflects the protean quality of American liberalism. Alan Brinkley focuses on the range of choices New Dealers faced. Alonzo Hamby traces the Democratic Party's evolving effort to incorporate New Deal traditions in the Cold War era. Richard Fried offers a fresh look at the impact of McCarthyism. Richard Polenberg situates Robert Oppenheimer, the father of the atomic bomb, in a tradition of liberal thought. And Melvin Urosfsky shows how the Roosevelt Court set the legal dimensions within which the debate about the meaning of liberalism would be conducted for decades. Other subjects include the effect of the Holocaust on relations between American Jews and African Americans; the limiting effects of racial and gender attitudes on the potential for meaningful reform; and the lasting repercussions of the tumultuous 1960s. Provocative, illuminating and sure to raise questions for future study, The Achievement of American Liberalism testifies to a vibrant and vital field of inquiry.
