Judicial equity developed in England during the medieval period, providing an alternative access to justice for cases that the rigid structures of the common law could not accommodate. Where the common law was constrained by precedent and strict procedural and substantive rules, equity relied on principles of natural justice - or 'conscience' - to decide cases and right wrongs. Overseen by the Lord Chancellor, equity became one of the twin pillars of the English legal system with the Court of Chancery playing an ever greater role in the legal life of the nation. Yet, whilst the Chancery was commonly - and still sometimes is - referred to as a 'court of conscience', there is remarkably little consensus about what this actually means, or indeed whose conscience is under discussion. This study tackles the difficult subject of the place of conscience in the development of English equity during a crucial period of legal history. Addressing the notion of conscience as a juristic principle in the Court of Chancery during the sixteenth and seventeenth centuries, the book explores how the concept was understood and how it figured in legal judgment. Drawing upon both legal and broader cultural materials, it explains how that understanding differed from modern notions and how it might have been more consistent with criteria we commonly associate with objective legal judgement than the modern, more 'subjective', concept of conscience. The study culminates with an examination of the chancellorship of Lord Nottingham (1673-82), who, because of his efforts to transform equity from a jurisdiction associated with discretion into one based on rules, is conventionally regarded as the father of modern, 'systematic' equity. From a broader perspective, this study can be seen as a contribution to the enduring discussion of the relationship between 'formal' accounts of law, which see it as systems of rules, and less formal accounts, which try to make room for intuitive moral or prudential reasoning.

The Reformer John Calvin has influenced America in a formative way. Calvin remains respected as a theologian to whose work intellectuals on both the right and left appeal. In the nineteen-nineties, Evangelicals and Catholics Together (ECT) formed a politically influential ecumenical coalition to oppose abortion and change the culture. Its ecumenism of the trenches influenced the administration of George W. Bush and continues to influence religious elements in the Tea Party. Evangelicals in the coalition presume to speak for Calvin. This book provides a counter argument. Calvin rejects the ethics advocated by ECT, an ethics of individual virtue, conscience and natural right. Instead, he affirms an ethics of obedience to the authority of secular government as an institution with a divinely ordained mandate. This work considers the following themes in Calvin: Calvin on Faith. Modern and postmodern philosophical approaches, including Reformed epistemology, do not explain how Calvin understood faith. Faith is divine activity. Belief is human activity. Faith is not a belief system or worldview on which to base a political theology. The author provides four Augustinian theses about Calvin on faith Calvin on Sanctification. Calvin rejected virtue ethics or an ethics of individual conscience. His ethics require self-denial and service. An important requirement of his ethics is obedience to government. The author provides three theses about Calvin on sanctification, as a critique of attempts to revive virtue ethics.Calvin on Natural Law. Calvin’s doctrine of natural law is one of the most vexed issues in Calvin studies. The author provides five theses to clarify Calvin’s doctrine of natural law. For Calvin, secular government transcends the authority of conscience, and Christians in conscience are required to obey it. In conclusion, the author discusses Karl Barth’s interpretation of Calvin and its relevance for the church struggle against the Third Reich. Based on his analysis of Calvin, he provides a defense of gay marriage and the right to terminate a pregnancy, as well as an analysis of religious freedom. Calvin would reject ECT’s theology of virtue, conscience and natural law. But he would affirm its ecumenism as a possible path out of culture war.

Every now and again, a work will be published by a reformer or puritan that Christians find to be of such great spiritual worth, that it is hard to put into words the incalculable and infinite good that such a work is to the Christian soul. This book, friends, is one of those works. Burroughs expounds Matthew 11:28, “Come unto me all ye that labor, and are heavy laden, and I will give you rest.” Christ invites sinners to come to Him for rest. Sinners, in this way, can be either Christians or unbelievers. Both are beckoned to “come.” In this work Burroughs shows first, the burden of sin, the burden of the Law, the burden of legal performances with the misery of those that are under them, the burden of corruption, and the burden of outward affliction. Secondly, he shows that Christ graciously offers to them that come to him, rest from all those burdens. In this he demonstrates what it is to come to Christ; that Christ requires nothing but to come to him. Several Rules to be observed in right coming to Christ, the means to draw souls to Christ, that in coming to Christ God would have us have respect toward ourselves, that there is no rest for souls out of Christ, and the reasons for this, with some conclusions from it. Thirdly, Burroughs shows the rest believers have from sin, that the deliverance from the Law by Christ is, privatively, and positively. He will show the rest believers have from the burden of the Law by coming to Christ, how Christ gives rest from the burden of legal performances, how Christ gives rest from the burden of corruption; in which is shown how sanctification and holiness comes only from Christ. And Burroughs demonstrates encouragements to come to Christ for holiness. He will explain how Christ gives rest from outward afflictions, and then considers some directions on how to get rest from Christ in spiritual desertions. God’s people have been personally helped by Burroughs throughout the centuries by all his works, and in this volume on coming to Christ, he again shows the inestimable spiritual value of his preaching and writing. This is a life-transforming work which will enable Christians to inwardly examine themselves as they consider how the Law of God correlates to their abiding in the Lord Jesus, and what steps they must take to come to Christ in a saving and sanctifying manner.
