Excerpt: ...A witness has before him the fear of infamy attaching to one detected in a lie, the fear of com'm'itti11g sin and the knowledge that there was such a thing us prosecution for perjury. He thought there should be more prosecutions for deliberate perjurv. He mentioned _fi'e causes why people were sometimes unable to speak the truth, though willin1: --(I.) Lack of opportunity to observe the matters as to which they were a5l1Ed to give evidence. (2.) A defective tion. _ _ (3-) Want of judgment to discriminate facts from inferences. (4.) Bad memory. _ (5.) Want of power to express clearlfv and accurately what was clear to thflllh faculty oi observa true, the defendant's solicitor could go in the box and deny it. The Court of Appeal said this was a "shocking suggestion" aud a "monstrous charge," the result being that the verdict obtained was not allowed to stand. The four most important points of divergence between the mercantile laws of England and Scotland are probably the following: ---(1.) In contracts, the absence from Scottish law of consideration. (2.) In sales, the absence from Scot tish law of the provisions oi the Statute " of Frauds, now embodied in section 4 of the "Sale of Goods" act. (3.) In companies' law, the absence from the law of Scotland of "floating charges." (4.) In partnership, the absence in Scottish law of the firm as a separate person. There appears to be no foundation for the statement published that Mr. Asquith, K.C., M.P., intends to retire from practice at the Bar. Sir John Madden, Victoria, recently threw an interesting light on the Sensations experienced by a judge in sending a fellow-mortal to the scaffold, or to imprisonment for a long term of years....
