For nearly fifty years, Professor Harry Glasbeek has been at the forefront of legal scholars and public intellectuals challenging assumptions and understandings about the injustices embedded in the economic, social, political and legal orders of Western capitalist democracies. His writings and teachings have influenced generations of law students, academics and activists. The Class Politics of Law brings together eleven incisive contributions from pre-eminent scholars across several disciplines activated by the same desire for democracy and justice that Glasbeek advances, showing how capitalism shapes the law and how the law protects capitalism. This collection foregrounds a class analysis of the law’s responses to corporate killing, workplace violence, surveillance, worker resistance and income inequality, among other issues.

Law is the great concealer; and law is everywhere. Or so claimed Marxists once upon a time. [Law] was imbricated within the mode of production and productive relations themselves . . . it intruded brusquely within alien categories, re-appearing bewigged and gowned in the form of ideology; . . . it was an arm of politics and politics was one of its arms; it was an academic discipline, subjected to the rigour of its own autonomous logic, it contributed to the definition of the self-identity of both the rulers 1 and the ruled. Does the old critique of domination still hold any sway? Apparently not. Or so even scholars of the far Left keep reminding us in their eagerness to embrace law and proclaim their allegiance to the new constitutional politics of civil society. Old Marxists now describe popular sovereignty as 'co-original' with, and democracy 'internally linked' to 2 constitutional rights and find it hard to remember what it was they once disagreed with liberals about. No tension left between emancipatory politics and oppressive law; instead we have reciprocal constitution, simultaneous realisation. In the Left's embracing of the new constitutionalisms its old critique of law - the critique of the law's concealment of class inequality, class conflict and class action - is left behind.

In recent years collective litigation procedures have spread across the globe, accompanied by hot controversy and normative debate. Yet virtually nothing is known about how these procedures operate in practice. Based on extensive documentary and interview research, this volume presents the results of the first comparative investigation of class actions and group litigation 'in action'. Produced by a multinational team of legal scholars, this book spans research from ten different countries in the Americas, Europe, Asia and the Middle East, including common law and civil law jurisdictions. The contributors conclude that to understand how class actions work in practice, one needs to know the cultural factors that shape claiming, the financial arrangements that enable or impede litigation, and how political actors react when mass claims erupt. Substantive law and procedural rules matter, but culture, economics and politics matter at least as much. This book will be of interest to students and scholars of law, business and politics. It will also be of use to public policy makers looking to respond to mass claims; financial analysts looking to understanding the potential impact of new legal instruments; and global lawyers who litigate transnationally. The essays that comprise Studies in Law and Politics are by and large academic. But Laski had a purpose in addition to the purely scholarly: he was eagerly pursuing possibilities for social and political change. Laski sought tirelessly for opportunities to act on those possibilities and, as is the case throughout his work, his academic and political purposes have no clear boundary between them.Studies in Law of Politics was published at a crucial juncture in Laski's ideological metamorphosis. During this period he had become increasingly worried that socialists might not be able to achieve the growth of working-class power. Although the essays contained in the volume cover a wide range of topics, and a wide span of time since the mid-1920s, he brought them into unity by a common approach. Though he does not make his unifying premise immediately evident to his readers, he clearly meant to chart the growth of power of those who had previously been without influence. His goal also was to identify the problems facing growth in a highly modernized society.Studies in Law and Politics reveals Laski's growing realization that the road to socialism might be more difficult than what he had believed when he wrote his pluralist works. The book reflects the mind of a thinker who was not content to write exclusively as an academic or a political activist. His view was that, while progressive reforms have been achieved in the past, they are not easily accomplished, and obstacles to further reforms should not be underestimated. This sober work offers much insight into Laski's intellectual development, as well as the times about which he wrote.

Class Privilege written by H. J. Glasbeek and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017 with Capitalism categories.

Capitalism's agenda is the endless pursuit of private accumulation of socially produced wealth. In our system, the corporation--created by law--is meant to hide this agenda, to distract us so that flesh and blood capitalists can do what they like. But when the workings of the corporation are examined, they reveal a betrayal of the very values and norms that, for their legitimacy's sake, capitalists in our parts of the world purport to share. Harry Glasbeek highlights one of capitalism's weak spots-the perverting economic, political, and ethical roles played by the prime instrument of private wealth accumulation: the legal corporation. Once the corporate mask is ripped off, those who hide behind it become visible. Stripped of their protective garb, the capitalist class will be just as naked as the rest of us are when we face their corporations.

The work of both socio-legal scholars and specialists working in social movements research continues to contribute to our understanding of how law relates to and informs the politics of social movements. In the 1990s, an important line of new research, most of it initiated by those working in the law and society tradition, began to bridge the gaps between these two areas of scholarship. This work includes new approaches to group legal mobilization politics; analysis of the judicial impact on social reform struggles; studies of individual legal mobilization in civil disputing and an almost entirely new area of research in cause lawyering. It brings together the best of this research introduced by a detailed essay by the editor.

This text studies the inextricable links between law, society, and politics through an in-depth examination of the institutions for law-making in the United States, focusing on the function, structure, and participants in the process. The institutions-oriented approach focuses on contemporary coverage of the interrelationship between law and society, and includes discussion of controversial topics, such as the influence of race, class, sex, and corporate governance on the law. Law, Politics, and Society also looks at the theoretical and philosophical foundations of American law and provides comparative and international perspectives. Diversity is embedded into each chapter within the readings—drawn from a broad range of interdisciplinary sources such as sociology, history, and medicine—as well as in activities, which encourage discussion about law and race, national origin, sex, and class. In addition, excellent coverage of how the law has changed since September 11, 2001 helps students understand these complex relationships in a tangible way. Popular Culture features use a series of photographs to help students understand how law both informs and is informed by popular culture. Law in Action features apply the concepts of each chapter to an actual law in order to illustrate the central point and to help students better understand theoretical concepts. Pedagogy throughout the text includes active learning exercises, and marginal and bold definitions.

Much writing on the relationship between politics and law has been overwhelmingly theoretical. We know relatively little about the practical, day-to-day impact of law on politicians, their legal advisers and civil servants. Yet policy can be given effect through law; legislation often has partisan, political, pragmatic aims, and legal rules and procedures can exercise unwelcome constraints on politicians when developing and implementing policies. How do lawyers in government see their roles? How does politics affect the drafting of legislation or the making of policy? This volume begins to answer these and other questions in a number of settings. Contributors include former departmental legal advisers, drafters of legislation, law reformers, judges and academics, who focus on what actually happens when law meets politics in government. 'I do not hesitate to recommend this book, both to participants in political and legal process and also the interested general reader: it contains a great deal of first-class material and is a welcome addition to the literature in this area'. Saira Salimi, Statute Law Review 'One of the most noticeable features of this collection – and perhaps the main source of its originality and diversity – is the impressive range of contributors. Overall, this is a terrific collection of essays [which will] be of value to anyone interested in the 'stuff' of law and politics. Even those well versed in that 'stuff' will surely find some thought-provoking new perspectives here'. Joseph Tomlinson, The Journal of Legislative Studies 'Overall, this collection presents the complexities of the relationship between politics and law rather well, even if, as with most edited collections, one would struggle to refine a clear and focused conclusion having read all the chapters. However, while this is often a problem, here it more fairly represents the analytical differences that are evident in examining the subject'. Christopher May, Political Studies Review 'This rigorous, ranging and broad-minded book reflects the best of two worlds; it is a valuable read for those who try to walk the line between them'. Mark Davies, The Table 'The book provides well-rounded insight into the intricate relationship between Politics and Law'. J Kern, European Review of Public Law ' ... the value [of this volume] lies in the fact that it brings together a multiplicity of highly-respected voices, not only from academia, but also from institutional and professional levels, who have been working on the various possible ways of interpreting the relationship between politics and law'.
