The book traces the ways in which terrestrial animals have evolved from aquatic ancestors and discusses the means by which they are adapted to life on land. The most important physiological adaptations are those involving salt and water balance, the excretion of nitrogen, reproductive mechanisms and the sense organ and these are given priority. Evidence from fossil history is combined with that from the ecology and physiology of present-day species to assess the probable routes along which various evolutionary lines had moved on to land. Individual chapters are concerned with specific animal groups and emphasis is placed on comparisons of physiological mechanisms between closely related animals before attempting wider generalisations. The book closes with a brief account of the recolonisation of the sea and fresh waters by terrestrial animals.

He also underscores the tragic history of the indigenous peoples of these regions and shoes how they came to lose "possession" of their land to newly formed governments made up of Europeans with European interests at heart. Weaver shows that the enormous efforts involved in defining and registering large numbers of newly carved-out parcels of property for reallocation during the Great Land Rush were instrumental in the emergence of much stronger concepts of property rights and argues that this period was marked by a complete disregard for previous notions of restraint on dreams of unlimited material possibility. Today, while the traditional forms of colonization that marked the Great Land Rush are no longer practiced by the European powers and their progeny in the new world, the legacy of this period can be seen in the western powers' insatiable thirst for economic growth, including newer forms of economic colonization of underdeveloped countries, and a continuing evolution of the concepts of property rights, including the development and increasing growth in importance of intellectual property rights.

The dispossession of indigenous peoples by conquest regimes remains a pressing issue. This book, unlike most other books on the subject, contrasts two different colonial administrations – first the Chinese Qing Empire, then, from 1895, the Japanese. It shows how, under the Chinese legal system, the Qing employed the Chinese legal system to manage the relationship between the increasing numbers of Han Chinese settlers and the indigenous peoples, and how, although the Qing regime refrained from taking actions to transform aboriginal land tenure, nevertheless Chinese settlers were able to manipulate aboriginal land tenure to their advantage. It goes on to examine the very different approach of the Japanese colonial administration, which following the Meiji Restoration of 1868 had begun to adopt a Western legal framework, demonstrating how this was intentionally much more intrusive, and how the Japanese modernized legal framework significantly disrupted aboriginal land tenure. Based on extensive original research, the book provides important insights into colonisation, different legal traditions and the impact of colonial settlement on indigenous peoples.
