Migrants should not be detained without legitimate reasons or forcefully send back to their home country. The harmonization of the different European legal systems has reached the field of asylum and immigration policy. The Maastricht Treaty has established the legal basis for a common migration policy. Numerous resolutions, recommendations, joint positions and actions were adopted by the EU Council based on the `third pillar' in the Maastricht Treaty. Within the `first pillar' the European Community has enacted regulations on visa policy based on Art. 100c EC - Treaty. Additionally, several agreements with third countries on immigration issues were set into force. Immigration and Asylum Law and Policy of the European Union comprehensively describes the present state of the harmonization process concerning migration policy in the European Union. Particular emphasis is laid on the legal status of third-country nationals with regard to entry and residence. Furthermore, the gaps within EU regulations are evaluated in an attempt to search for a homogenous European migration policy.

The present volume is based on an international summer school on migration, asylum and refugee law that took place in Barcelona in the fall of 2018, sponsored by the German Academic Exchange Service and in cooperation between the universities of Barcelona and Hamburg. In the spirit of intergenerational academic exchange, students, young researchers, and established experts engage in interdisciplinary discussions on fundamental questions of migration law and migration policy, which have become more virulent than ever since the refugee protection crisis of 2015. European, human rights and international law aspects are supplemented by national perspectives from Belgium, Bulgaria, the Federal Republic of Germany, Italy, Spain, Turkey and the United Kingdom. The entire project sees itself as a laboratory for the exchange of ideas, for reflection and further thinking about what open constitutional states, the European Union and the international community are equally challenged by today: a migration regime based on human rights, which takes into account security interests and is practicable in a world in which more and more people from ever more different backgrounds are seeking a future beyond their country of origin.

Large-scale migration constitutes an unavoidable social reality within the European Union. A European polity is made possible and tangible by the individual acts of migrants crossing the internal borders, developing a transnational life and integrating into European societies. Consequently, migration has become a special feature of the self-understanding of the European Union: its existence depends upon a continuing flow of persons crossing the borders of the Member States, and also upon the management of the flows of third-country nationals knocking at its doors. To respond to this challenge, the Union has developed common European migration policies. This book is a collection of essays which aim to explore a selected number of issues related to the development of these policies. It presents the current state, and the future of European immigration law discussing the political rationales and legal competences driving the action of the Union in this area. It reflects on the cooperation of the Union with third countries and on the emergence of international migration legal norms. It illustrates the role of the European Courts and the emergence of new actors through the adoption of EU instruments.

Refugees Security And The European Union written by Sarah Léonard and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-06-07 with Political Science categories.

This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. It argues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies – more precisely securitization theory – by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU’s policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations.

Migration Borders And Asylum written by Thierry Balzacq and has been published by CEPS this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005 with Asylum, Right of categories.

What level of policy convergence has been achieved by EU member states on immigration, borders and asylum? Although this question may sound rather theoretical, in practice it has profound consequences on the everyday life of individuals and the very nature of the EU. Common action in this field is exacerbated by the significant obstacles that negatively impact the quality of policies and the success of their implementation. Together with the tense EU struggle between the intergovernmental and community method of governing, these factors are detrimental to an EU-wide policy for promoting freedom, justice and stability in an enlarging Union. In response, authors Thierry Balzacq and Sergio Carrera undertake a critical analysis of the most recent policy developments in this politically sensitive domain. They investigate persistent barriers to harmonisation and suggest how the EU may achieve policy optimalisation. Their work progressively develops a set of recommendations, aimed at overcoming current vulnerabilities in policy approximation and achieving the most appropriate action to ensure equal treatment and social cohesion in the EU.
