The Convention on the Rights of the Child is the most ratified of all the United Nations Human Rights treaties. Adopted by 191 nations, it is a comprehensive treaty covering the child's civil-political, economic-social-cultural, and humanitarian rights. In the over twenty years since the Convention went into force, the Committee on the Rights of the Child (the experts who monitor State Party compliance) has issued its evaluation of the reports of State Parties on their progress in implementing the Convention and their recommendations for future improvements. The Committee's Concluding Observations collectively make up the jurisprudence on child rights. Due to the sheer volume of reports, this information is not easily accessible to scholars and child rights activists. These volumes provide quick access to the Committee's jurisprudence on an article-by-article basis. By dividing the Concluding Observations for each State Party into sections corresponding to specific articles of the Convention, a researcher can identify the exact language of the Committee's comment on a particular article for each state party and can evaluate trends in the Committee interpretation. Those interested in understanding and promoting the rights of children and in the developing worldwide jurisprudence in this important area will find this extensive compilation an invaluable resource. Published under the Transnational Publishers imprint. All volumes of the print edition are available in individual e-books: 9789004531185 (volume 1) - 9789004531192 (volume 2) - 9789004531208 (volume 3) - 9789004531215 (volume 4).

Litigating The Rights Of The Child written by Ton Liefaard and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-09-29 with Social Science categories.

This book examines the impact of the UN Convention on the Rights of the Child (CRC) on national and international jurisprudence, since its adoption in 1989. It offers state of the art knowledge on the functions, challenges and limitations of the CRC in domestic, regional and international children’s rights litigation. Litigating the Rights of the Child provides insight in the role of the CRC in domestic jurisprudence in ten countries from different parts of the world, with civil law, common law and Islamic law systems. In addition, it offers analyses of the jurisprudence of regional courts, in Europe and the Americas, and of human rights treaty bodies, including the Human Rights Committee, Committee on the Elimination of Discrimination against Women and the African Committee of Experts on the Rights and Welfare of the Child. This book presents a global and comparative picture on the use of the CRC in litigation and identifies emerging trends. This book serves as an important source of reference and inspiration for academics, students, legal professionals, including judges and lawyers, and (inter)national organisations working in the area of children’s rights.

Child Law written by Laura Westra and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-06-17 with Law categories.

Child Law starts with the question “Who is the Child?” In direct contrast to the CRC, which calls for putting the interests of the child first in all policies dealing with children, it appears that the interests of others are the major consideration de facto. In law, children’s right to protection is severely limited by the presence of a maximum age limit, with no consideration of the starting point: current and ongoing scientific research has demonstrated the effects of this non-consideration in a number of abnormalities and diseases, not only in children, but in adults and the elderly. The WHO has published a number of studies to that effect and the 2012 Report on Endocrine Disruptors more than confirms this claim. This and other scientific insights that have largely been ignored show the flaws and inadequacies of the legal regimes intended to protect children, in a number of areas, from the basic public health to the right to normal development; child labor law conventions; in conflict situations; as a result of climate and other events; children as illegal migrants and as inmates in prison camps.

The International Law On The Right Of The Child To Survival And Development written by Khadeija Elsheikh Mahgoub and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016 with Children categories.

This comprehensive and in-depth study on the understanding and interpretation of the child's right to survival and development provides a compact assessment of article 6(2) of the Convention on the Rights of the Child (CRC) in light of its drafting history, the reports of the Committee on the Rights of the Child and other relevant sources appropriate to the discipline of international human rights law.The author analyses the travaux prparatoires of the CRC and the academic work of some of its drafters. The book includes an interview with one of the drafters and explores the literature of the Committee on the Rights of the Child with respect to article 6(2) and how its understanding and interpretations of this article have developed over time. It examines the weaknesses and strengths in relation to the observations it has made and explores the legal effects of the Committee's classifications and makes suggestions for others as well.Importantly, the book also discusses the relationship between the right of the child to survival and development and his/her dignity. It provides an understanding of the child's physical, mental, spiritual, moral and cognitive development in the context of his/her right to survival and development. In addition, the author discusses various State obligations aiming at the enjoyment of the right to survival and development and also touches on global warming and its relationship with the right of the child to survival and development. The reader will gain an understanding of different approaches to the interpretation of human rights treaties in general, and attitudes towards the assessment of the work of the Committee on the Rights of the Child. He will also learn about the connection between the right to development and the economic and social rights of the child on the one hand, and the right of the child to survival and development on the other hand. Moreover, the book introduces the concept of comprehensiveness and individuality of the right of the child to survival and development and fundamentally argues that there is still more to add to the understanding and interpretations of article 6(2) of the CRC.

Monitoring State Compliance With The Un Convention On The Rights Of The Child written by Ziba Vaghri and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-01-03 with Education categories.

This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.
