Most of the countries in the European Union are immersed in the analogue-digital switchover, and it is envisaged that by the end of 2012 all of the countries will have changed over to digital television, giving rise to the digital dividend in Europe. The recently harmonisation of the 800MHz band as the European digital dividend will have different impact on EU member states. In this paper we will address the question regarding the impact of digital dividend harmonisation on national planning for the development of Digital Terrestrial Television (DTT) in United Kingdom and Spain. Taking these two countries as our reference points, we will see that their DTT transition models differ greatly. In the UK, the digital transition was based on a centralised model designed to release a major portion of the spectrum, whereas the Spanish model is highly decentralized, both regionally and locally. In Spain, the introduction of digital television has sought to respond to regional and local communication needs, virtually casting aside the release of the digital dividend for the provision of wireless communications services other than broadcasting. The lack of European coordination and the limited foresight of the Spanish authorities regarding the increase in spectrum demand will make the digital transition in Spain far more expensive, given the need to reassign the frequencies subject to European harmonisation. Unlike the UK, which had already envisaged the release of a large amount of spectrum, in Spain, the impact of European harmonisation on national DTT planning will inevitably be greater. The structure of this paper will consist of an identification of the regulatory framework and the directives issued by EU institutions in relation to European policy on the development of digital terrestrial television, a prior and necessary step to complete our understanding of EU actions involving the digital dividend. The switch from analogue to digital terrestrial television in the UK is due to start in October 2007 and will result in a significant release of spectrum for new uses. The switchover process will release 112 MHz of the 368 MHz currently used for analogue terrestrial broadcasting; the remaining 268 MHz has been pre-allocated in the UK for the delivery of digital terrestrial television. The spectrum which is to be released (the “digital dividend”) is particularly valuable; it lies between 470 and 862 MHz, hence is in the spectrum “sweet spot” - the portion of the radio spectrum which combines good propagation (hence good coverage both inside buildings and in rural areas) with sufficient spectrum availability for services that require large capacity or bandwidth. The range of potential uses of this spectrum is especially wide, including standard and high definition digital terrestrial television, mobile multimedia, cellular mobile, wireless broadband, satellite communications, wireless microphones, low power applications and public safety services. There is also a high degree of uncertainty over its most efficient use now and in the future. In these conditions an auction is likely to bring significant benefits to UK consumers. Therefore, Ofcom is consulting on a proposal to allow the market to decide on the future use of the digital dividend. This represents a significant development in the application of market mechanisms to spectrum management, because (if the proposal is maintained) it will be one of the first times an auction has been used to determine the division of spectrum between broadcasting and non-broadcasting uses. Spectrum regulators around the world are increasingly turning to market mechanisms to allocate spectrum, and the use of markets is at the heart of Ofcom's stated approach to spectrum management. However, deciding to use markets to allocate this spectrum has raised a number of questions about the suitability of markets, which Ofcom has addressed to verify that its preferred approach is the right one for the award of this spectrum. These questions arose out of arguments for why broadcasting uses should be considered as a separate case (arguments which have a similar resonance on both sides of the Atlantic).

The advent of digital television has triggered a revolution in the use of radio spectrum worldwide and in particular in Europe, where the digital switchover, meaning the migration process from analogue to digital broadcasting, has led to two major consequences on spectrum use. First of all, there has been an improvement in the quality and an expansion in the range of television services, but also a significant part of the Ultra High Frequency (UHF) band has become free from traditional terrestrial broadcasting usage and released for other services. In response to the outcome of the 2007 World Radiocommunication Conference (WRC-07) to allocate the upper part of the UHF band - the 800 MHz in Europe - for mobile services, Europe committed to structuring a regional plan promoting harmonisation of spectrum use across EU member states. In 2012, the first Radio Spectrum Policy Programme (RSPP) was approved. EU member states agreed on clearing the 800 MHz band from television broadcasting services and making it available for mobile services by 1 January 2013 (European Parliament & the Council, 2012). However, some EU member states showed a high degree of sensitivity about how intrusive the RSPP could be in the policy area of radio spectrum, which is considered a core area of national sovereignty. It is suffice to think that fourteen EU member states asked the European Commission (EC) to grant policy derogations due to a variety of exceptional reasons, having missed the previously agreed deadline, and nine of them have actually been granted. Different paths towards the allocation of the digital dividend to mobile services, in terms of policy and regulatory interventions, have been traced by EU member states under the EU umbrella. Moreover, Europe is carrying out studies on future spectrum requirements, including the 694-790 MHz (700 MHz) band, which will be allocated to mobile services in Europe from 2016, according to what has been stated at the 2012 World Radiocommunication Conference (WRC-12). This band is used to be referred to with the expression "second digital dividend".
