Enforcement of EU law has become increasingly 'Europeanized'. But how is and can it be organized in the integrated legal order of the EU to promote effective enforcement? In light of the recent institutional and substantive changes in the area of EU financial markets regulation, this article identifies four models (S, M, L, and XL models) of enforcement of EU law. It discusses the possibilities and challenges to effective enforcement of each of such models and the major trade-offs which policy-makers face at the EU and national levels when designing enforcement frameworks, namely centralization vs. decentralization (an institutional perspective) and harmonization vs. differentiation (substantive and procedural perspectives). It argues that at least a minimum degree of institutional centralization is necessary to promote the uniform enforcement and implementation of EU policies in a Union with 28 legal systems. The more specific details, such as specific institutional shape of centralized bodies (should it be a network, an agency or an EU institution?) and of the distribution of functions between the national and EU level are better addressed on a case-by-case basis in light of the political, economic, and social characteristics of the sector at stake.

The existence of a structured enforcement system is an inherent feature of national legal orders and one of the core elements of State sovereignty. The very limited power to issue sanctions has often been deemed a gap in the EC legal order. Over the years, the situation has progressively changed. The Union’s institutional setting is growing in complexity and a variety of agencies has been or is expected to be endowed with law enforcement responsibilities. In addition, the so-called competence creep has led the EU to play an increasingly prominent role in several areas of EU law enforcement, including the issuing of sanctions. This book examines these developments, focusing on both the general features of the EU legal order and the analysis of key-substantive areas, such as banking and monetary union, environmental law, and data protection. More than decade ago EU financial regulation introduced modern, systematic and detailed administrative regulation of investor protection. In general, it did not address the civil law effects of this regime and did not specify civil remedies for the protection of the investors, except some minor exceptions, which existed even in that stage of EU financial regulation. However, the reaction to the global financial crisis forced to reconsider EU legislative policy towards enforcement efficiency and that, in turn, has led to the recent shift, albeit slight, in the attitude on the private enforcement of EU financial regulation, as evidenced by particular elements of civil actions in the EU financial markets law. As the EU system of private enforcement just recently started to emerge, it is hardly possible, that private enforcement of EU financial regulation will become fully harmonized in near future. When EU legislator will proceed further with the task of harmonization, before doing so, it would be rational to learn from the different national experiences, which encompass both - failures and solutions in the field of private enforcement of EU financial regulation. Lithuanian experience has shown that principles of private law, which were perfected for several millenniums, even today, when EU financial regulation is very detailed, sophisticated and advanced, are able to offer efficient solutions and support public supervision of financial markets - a clear domain of public law. However, Lithuanian experience has shown also particular weaknesses of the civil justice in the pursuit of private enforcement of EU financial regulation.

The objective of this book is to examine how the legal order of Malta, the EU's smallest Member State, manages to cope with the obligations of the EU's acquis communautaire. As far as the legal obligations are concerned, size does not matter. Smaller Member States have the same obligations as the largest, yet they have to meet these same obligations with very fewer resources. This book examines how the Maltese legal system manages to fulfil its obligations both in terms of the supremacy of EU law, as well as how the substantive EU law is transposed and implemented. It also explores how Maltese courts look at EU law and how they manage, or not manage, to enforce it within the context of national law.
