The European Union (EU) and the World Trade Organization (WTO) are becoming ever more important players on the international legal scene, as well as points of reference for the development and functioning of similar institutions elsewhere. Both institutions initially had a relatively small trade-focused mandate, which has been significantly expanded over the past decades so that there are few legal issues today that are not, in some way, affected by EU or, perhaps to a lesser extent, WTO law. Today, the EU and the WTO interact on a global scale as rule-makers and – enforcers, with repercussions for the entire world’s population. Nevertheless, they are currently experiencing a backlash. Both institutions are likely to undergo major reform in the next years: the book scrutinizes current proposals and makes an educated attempt at predicting upcoming changes in the EU and the WTO format. This book presents a new theoretical framework for understanding the regulation of international trade. For this purpose, it analyses a series of integrated studies of relations between the EU, the WTO and China. It consists of three main parts. Part I introduces the basic concepts. It surveys the literature on law and globalisation, introduces the concept of sites of governance and the theory of global legal pluralism and sketches the foundations of global legal pluralism. It shows that each site of governance has both a structural dimension, consisting of institutions, norms and dispute resolution processes, and a relational dimension, comprising its relations with other sites of governance. The totality of sites of governance constitutes a new form of global legal pluralism. Part II analyses global legal pluralism in action in relations between the EU, the WTO and China. It examines the construction of relations between sites, ways in which relations between sites give rise to new legal concepts or transform the character of rules, the tension between regionalism and international integration and the governance of international production networks. It emphasises the reciprocal interaction between the structural features and the relational features of sites. Part III explores new directions in global legal pluralism. It first analyses regional trade agreements as a way of creating new sites of governance, focusing on agreements involving China. Then it considers how to enhance ethical values in international trade regulation. Based on an institutional analysis of relations between the WTO and other sites of governance, it proposes ways in which global legal pluralism can be used to reform the WTO, today the predominant institution in the regulation of international trade, including trade between the EU and China.

Seminar paper from the year 2004 in the subject Politics - Topic: European Union, grade: 1,0 (A), Hamburg University of Ecomomy and Policy (Political Science), course: Globalisation and European Governance, language: English, abstract: In general terms, both the European Union (EU) and the World Trade Organization (WTO) can be described as governance systems: “Governance is about the structured ways and means in which the divergent preferences of interdependent actors are translated into policy choices to allocate values, so that the plurality of interests is transformed into co-ordinated action and the compliance of actors is achieved.”1 This essay cannot reflect all aspects of the two governance systems, but is limited to a selection of their differences, similarities and mutual influences. After the opening remark alludes to a similarity, the differences will be touched upon next. The individual characteristics of the EU and the WTO become particularly obvious in the institutional set-ups of the two organisations: In the case of the EU one deals with a supranational organisation, what means that the current 15 member states partly transfer sovereign rights to the organisation, thus rendering the EU a partly independent and powerful policy actor. In comparison, the WTO is an intergovernmental organisation, in which its 146 members negotiate without transferring any sovereignity to the organisation, thus depriving the WTO of any independence in policy decisions 2. The WTO is a broad international organisation, its members accounting for over 90 % of all trade in the world, whereas the EU, being a member of the WTO, is a geographically limited and closely integrated organisation. Even though the EU represents just 6 % of the world’s population, it accounts for more than a fifth of global imports and exports3. Concerning the relationship between the two organisations, their origins had an important influence: The WTO was founded in 1995 as a successor of the General Agreement on Tariffs and Trade (GATT) from 1947.
