From this time on there have been a lot of vehement and controversial discussions mainly concerning the role of this European Parliament (EP) and its legitimacy. Keeping this in mind, before lighting up the details of the institutional reform process - mainly focussing the recent Convention (-Debate) -, I will present the basic principles of constitution, tasks and functioning of the European Parliament. As said in the Treaty of Rome from 1957 the European Parliament represents the people of the Member States of the European Community. Thus “375 million European citizens in 15 countries are now involved in the process of European Integration through their 626 representatives in the European Parliament1” (http://www.europarl.eu.int/presentation/default_en.htm, 30.04.03). In its constituting session on March 21, 1958 the general assembly was named “European Parliament”. Until 1979, every five years the European Parliament is build by direct universal elections. The main tasks of the EP are consultation and supervision; it is also featured with the right to sue to the Court of Justice. The seat of the plenum of the EP is in Strasbourg – supplementary the Committees hold their meetings in Brussels, the General Secretariat remained in Luxembourg. The tasks of the EP are composed of the general legislative power, the constitutional right to decide on the budget, the right of control and interaction. To explain this aspects more detailed: · The general legislative power: The Parliament grew from a kind of forum to a shaping actor (cp. Schmuck 1994: p.22). By dint of the so called isoglucose case the European Parliament was given a “very useful delaying power” (Nugent 2001:p.207). This book analyses the EU's Constitutional Treaty, which emerged in draft form from the European Convention in the summer of 2003 and which was finalised by an Intergovernmental Conference (IGC) in June 2004. It describes the main novelties of the treaty and looks at policies of important actors, Member States and Community actors (the Commission and European Parliament) and the roles played by the Convention and the Italian and Irish Presidencies during the process of deliberation and negotiation that produced the treaty. It further studies the failure of ratification in France and the Netherlands and the implications for the process of European integration of this failure. It finally touches on the question whether a constitutional equilibrium has been reached. Since the new Lisbon Treaty negotiated in 2007 contains much of what was in the Constitutional Treaty the analyses of the book remain pertinent for this latest EU treaty.

A European public law is under construction, but how has this occurred and what is its character? Stirn proposes that this European public law is being constructed by the convergence of three circles: the law of the European Union, the law of the European Convention on Human Rights, and the different domestic legal orders. The mutually influential relationship of these constituents has allowed them to develop, most considerably in the jurisprudence of the Court of Justice of the European Union and the European Court of Human Rights. The book begins by reflecting on the different phases of the development of the European project from the end of the First World War. It outlines the transition from the European Coal and Steel Community to the European Union, as well as the other institutions contributing to these developments. The discussion then moves to the European legal order, which consists of the law of the European Union and the European Convention on Human Rights. Stirn explores how, in spite of occasional false starts and frictions, their relationship is becoming ever closer, and how their characteristics in law are becoming increasingly similar. Furthermore, Stirn analyses the relationship between European law and national legal systems. The differing approach to domestic incorporation of international law, whether it be monist or dualist is considered, as well as the recognition that European law is superior to domestic law. The character specifically of EU law, and how it compares to international and domestic law is also discussed, in particular its unique features but also the principles it shares with domestic law. In addition, the book examines the existence or not in member states' of constitutional courts, the level or jurisdictional orders and the recruitment and status of judges. Similar trends across Europe in public administration are also accounted for and subjected to analysis. Stirn concludes that a European model of public administration is becoming apparent.
