The Conflict In Syria And The Failure Of International Law To Protect People Globally written by Jeremy Julian Sarkin and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2021-11-28 with Law categories.

This book explores, through the lens of the conflict in Syria, why international law and the United Nations have failed to halt conflict and massive human rights violations in many places around the world which has allowed tens of millions of people to be killed and hundreds of millions more to be harmed. The work presents a critical socio-legal analysis of the failures of international law and the United Nations (UN) to deal with mass atrocities and conflict. It argues that international law, in the way it is set up and operates, falls short in dealing with these issues in many respects. The argument is that international law is state-centred rather than victim-friendly, is, to some extent, outdated, is vague and often difficult to understand and, therefore, at times, hard to apply. While various accountability processes have come to the fore recently, processes do not exist to assist individual victims while the conflict occurs or the abuses are being perpetrated. The book focuses on the problems of international law and the UN and, in the context of the many enforced disappearances and arbitrary detentions in Syria, why nothing has been done to deal with a rogue state that has regularly violated international law. It examines why the responsibility to protect (R2P) has not been applied and why it ought to be used, generally, and in Syria. It uses the Syrian context to evaluate the weaknesses of the system and why reform is needed. It examines the UN institutional mechanisms, the role they play and why a civilian protection system is needed. It examines what mechanism ought to be set up to deal with the possible one million people who have been disappeared and detained in Syria. The book will be a valuable resource for students, academics and policy-makers working in the areas of public international law, international human rights law, political science and peace and security studies.

Child sexual abuse has become a prevalent topic of study and discussion in the fields of Child Psychology, Pediatrics, Law Enforcement, and Social Work. But even with the widespread knowledge of identifiable behavior in its victims and abusers, society's response to child sexual abuse is failing profoundly. Rebecca Bolen's authoritative book, Child Sexual Abuse: Its Scope and Our Failure, clearly defines the scope of child sexual abuse and addresses society's ability to respond to the problem. It is her thesis that society's response to child sexual abuse is failing because the policies, programs, and statutes designed to assess and identify abuse are grounded in historical and myth-bound theoretical child sexual abuse literature rather than in the empirical knowledge base. This comprehensive text on child sexual abuse covers: The historical conceptualization of child sexual abuse, starting with Freud. A review of the empirical literature on the incidence and prevalence of child sexual abuse. The professional response to child sexual abuse. The most sophisticated model of risk of child sexual abuse done to date. Two new models of understanding reactions by nonoffending guardians. The pervasiveness of the threat of extrafamilial abuse. £/LIST£ This text is divided into three main areas of discussion: Sociohistorical Context, Scope of the Problem, and Aftermath. This comprehensive review can be used not only as a text, but also as a primary reference for professionals in government, law enforcement, medical, mental health, and any agency that works with child sexual abuse offenders and victims.

"Never again!" the world has vowed time and again since the Holocaust. Yet genocide, ethnic cleansing, and other mass atrocity crimes continue to shock our consciences—from the killing fields of Cambodia to the machetes of Rwanda to the agony of Darfur. Gareth Evans has grappled with these issues firsthand. As Australian foreign minister, he was a key broker of the United Nations peace plan for Cambodia. As president of the International Crisis Group, he now works on the prevention and resolution of scores of conflicts and crises worldwide. The primary architect of and leading authority on the Responsibility to Protect ("R2P"), he shows here how this new international norm can once and for all prevent a return to the killing fields. The Responsibility to Protect captures a simple and powerful idea. The primary responsibility for protecting its own people from mass atrocity crimes lies with the state itself. State sovereignty implies responsibility, not a license to kill. But when a state is unwilling or unable to halt or avert such crimes, the wider international community then has a collective responsibility to take whatever action is necessary. R2P emphasizes preventive action above all. That includes assistance for states struggling to contain potential crises and for effective rebuilding after a crisis or conflict to tackle its underlying causes. R2P's primary tools are persuasion and support, not military or other coercion. But sometimes it is right to fight: faced with another Rwanda, the world cannot just stand by. R2P was unanimously adopted by the UN General Assembly at the 2005 World Summit. But many misunderstandings persist about its scope and limits. And much remains to be done to solidify political support and to build institutional capacity. Evans shows, compellingly, how big a break R2P represents from the past, and how, with its acceptance in principle and effective application in practice, the promise of "Never

This open access book presents a discussion on human rights-based attributes for each article pertinent to the substantive rights of children, as defined in the United Nations Convention on the Rights of the Child (UNCRC). It provides the reader with a unique and clear overview of the scope and core content of the articles, together with an analysis of the latest jurisprudence of the UN Committee on the Rights of the Child. For each article of the UNCRC, the authors explore the nature and scope of corresponding State obligations, and identify the main features that need to be taken into consideration when assessing a State’s progressive implementation of the UNCRC. This analysis considers which aspects of a given right are most important to track, in order to monitor States' implementation of any given right, and whether there is any resultant change in the lives of children. This approach transforms the narrative of legal international standards concerning a given right into a set of characteristics that ensure no aspect of said right is overlooked. The book develops a clear and comprehensive understanding of the UNCRC that can be used as an introduction to the rights and principles it contains, and to identify directions for future policy and strategy development in compliance with the UNCRC. As such, it offers an invaluable reference guide for researchers and students in the field of childhood and children’s rights studies, as well as a wide range of professionals and organisations concerned with the subject.

The Preventive State written by Alan Dershowitz and has been published by Encounter Books this book supported file pdf, txt, epub, kindle and other format this book has been release on 2025-05-20 with Political Science categories.

"You shall thank Alan Dershowitz for writing this [valuable] book." —Stephen Breyer, Former Associate Justice of the Supreme Court If reliable but uncertain intelligence predicted a mass casualty terrorist attack and indicated likely suspects, what preventive actions would be constitutionally authorized? Detention? Interrogation? Torture? What if the attack involved a weaponized virus? Should the government compel widespread inoculation that might kill hundreds of people while saving millions? What if an article describing how to circumvent the inoculation mandate was about to be published? Should censorship of the article be authorized? These are the sorts of questions Alan Dershowitz has been asking for more than 60 years, in his teaching, writing, and litigation. Now, at age 86, he has written his magnum opus. In it, he suggests an overarching jurisprudential framework that would set limits to the ballooning power of what he calls “the preventive state.” This important book offers unprecedented insights into one of the most underexamined developments of our age: the growing magnitude and frequency of cataclysmic threats, coupled with the increasingly effective—but increasingly intrusive—tools intended to predict and prevent them. Dershowitz responds to the urgent need for a jurisprudence that provides balance and accountability as both dangers and preventive capabilities increase, threatening our security and our liberties. This masterful analysis should be read by everyone who cares about security, liberty, and democracy.

This book is driven by the question: what role is played by the local security research community in Kosovo’s internationally-led Security Sector Reform? Kosovo’s SSR has been heavily driven by international knowledge rather than the context-sensitive evidence, with negative implications for the legitimacy and sustainability of SSR. Centred on an analysis of an extensive interview survey of international SSR practitioners and local researchers in Kosovo and local research papers, this book highlights how local research has engaged with, challenged and contributed to international SSR. Despite the general experience of local marginalisation, local researchers have an important role to play. Following engagement with local research, international SSR practitioners may consider local context in greater depth and think more critically about SSR implications. This highlights the potentially key role that local researchers can play to support effective post-conflict recovery.
