In this book, articles by leading tort scholars from Australia, Canada, Hong Kong, Israel, New Zealand, the United Kingdom and the United States deal with important theoretical and practical issues that are emerging in the law of torts. The articles analyse recent leading developments in areas such as economic negligence, causation, vicarious liability, non-delegable duty, breach of statutory duty, intentional torts, damages, and tort law in the family. They provide a foretaste of the issues that will face tort law in the near future and offer critical viewpoints that should not go unheeded. With its rich breadth of contributors and topics, Emerging Issues in Tort Law will be highly useful to lawyers, judges and academics across the common law world. This is the eagerly awaited new edition of Law of Torts, the complete Irish tort law reference book. For this, the contents have been extensively revised since the last edition was published in 2000. Key developments are detailed and relevant recent case law is examined. This book is essential for both legal practitioners and people studying Irish law. Recent important legislation examined in the book includes: Criminal Law (Defence and the Dwelling) Act 2011, Civil Law (Miscellaneous Provisions) Act 2011, Defamation Act 2009, Consumer Protection Act 2007, Civil Liability and Courts Act 2004 and Personal Injuries Assessment Board Act 2003. Key developments and case law are examined in areas such as pure economic loss, limitations and purchase of financial products, vicarious liability for sexual assaults, damages, privacy, defamation, psychiatric injury, liability of public authorities, employers' liability, professional negligence, defective buildings and products and occupiers' liability. First published in 1980, Law of Torts has long been a cornerstone work in Irish law, indeed in the foreword to the first edition Judge Brian Walshe noted that the book represented a challenge to the 'unquestioned assumption that English text-books would satisfy all needs.' This new addition will only add to the book's long-established merit and value.

The Law of Tort Welcome to my series of pocket books in Irish Law which aimed at beginner-level readers with little or no previous experience of the Law of Tort. Torts are concerned with civil wrongs, whereby one party causes damage to another party. -Tort is the French word for a "wrong" or Latin for "twisted." -Tort is a branch of Civil Law; therefore a tort in law is called a "Civil Wrong" -Tort law protects a variety of injuries and provides remedies (ways to fix) them. Torts can be distinguished from legal wrongs: A Tort is not a breach of contract, where the obligation which is alleged to have been breached arose under an agreement between two parties. A Tort is not a crime, where the object of proceedings is to punish the offender rather than compensate the victim. Using tort law, an injured party can bring a civil case to seek compensation for a wrong done to the party (plaintiff, or injured party) or the party's property. Tort damages or compensation are monetary damages that are sought from the offending party. They are intended to compensate the injured party for the injury suffered.
