The vast majority of all email sent every day is spam, a variety of idiosyncratically spelled requests to provide account information, invitations to spend money on dubious products, and pleas to send cash overseas. Most of it is caught by filters before ever reaching an in-box. Where does it come from? As Finn Brunton explains in Spam, it is produced and shaped by many different populations around the world: programmers, con artists, bots and their botmasters, pharmaceutical merchants, marketers, identity thieves, crooked bankers and their victims, cops, lawyers, network security professionals, vigilantes, and hackers. ABSTRACT: Spam is a growing problem that affects individuals, businesses and Internet Service Providers. In sending these unsolicited commercial e-mails, spammers engage in cost shifting; although e-mail is cheap to send, it costs the recipient time, money, and resources to deal with it. This thesis surveyed the state anti-spam statutes aimed at ending cost shifting, and the common law theories of trespass to chattels, tortious interference with business relations, and nuisance, which are used by private individuals to remedy any injury garnered from receiving spam. More specifically, this thesis focused on the spam cases in which the courts analyzed how the First Amendment affects the litigation of spammers under the state anti-spam laws and the common law theories. This research found only a small number of spam cases analyzing the First Amendment. Two main themes appeared during this research. In the cases brought under the state anti-spam statutes, the courts focused on the false routing information or subject lines of the e-mails, thereby skirting true First Amendment analysis. The courts found that the statutes did not violate the First Amendment because they only regulated false speech. In the common law cases, the courts focused on the rights of private property owners. For the most part, the courts ruled that as private property owners, Internet Service Providers had the right to exclude spam messages from their network.
