Analyzes privacy policy instruments available to contemporary industrial states, from government regulations and transnational regimes to self-regulation and privacy enhancing technologies. Privacy protection, according to Colin Bennett and Charles Raab, involves politics and public policy as much as it does law and technology. Moreover, the protection of our personal information in a globalized, borderless world means that privacy-related policies are inextricably interdependent. In this updated paperback edition of The Governance of Privacy, Bennett and Raab analyze a broad range of privacy policy instruments available to contemporary advanced industrial states, from government regulations and transnational regimes to self-regulation and privacy-enhancing technologies. They consider two possible dynamics of privacy regulation—a "race to the bottom," with competitive deregulation by countries eager to attract global investment in information technology, versus "a race to the top," with the progressive establishment of global privacy standards. Bennett and Raab begin by discussing the goals of privacy protection, the liberal and individualist assumptions behind it, and the neglected relationship between privacy and social equity. They describe and evaluate different policy instruments, including the important 1995 Directive on Data Protection from the European Union, as well as the general efficacy of the "top-down" statutory approach and self-regulatory and technological alternatives to it. They evaluate the interrelationships of these policy instruments and their position in a global framework of regulation and policy by state and non-state actors. And finally, they consider whether all of this policy activity at international, national, and corporate levels necessarily means higher levels of privacy protection.

In the early 2000s, we surveyed and analyzed the global repertoire of policy instruments deployed to protect personal data in “The Governance of Privacy: Policy Instruments in Global Perspective.” In this article, we explore how those instruments have changed as a result of 15 years of fundamental transformations in information technologies, and the new digital economy that they have brought in their wake. We review the contemporary range of transnational, regulatory, self-regulatory and technical instruments according to the same framework, and conclude that the types of policy instrument have remained relatively stable, even though they are now deployed on a global scale, rather than in association with particular national legal and administrative traditions. While the labels remain the same, however, the conceptual foundations for their legitimation and justification are shifting as a greater emphasis on accountability, risk, ethics and the social/political value of privacy have gained purchase in the policy community. Our exercise in self-reflection demonstrates both continuity and change within the governance of privacy, and displays how we would have tackled the same research project today. As a broader case study of regulation, it also highlights the importance of going beyond the technical and instrumental labels. The change or stability of policy instruments do not take place in isolation from the wider conceptualizations that shape their meaning, purpose and effect.

The recent White Paper on privacy from the U.S. Department of Commerce encourages, "the development of voluntary, enforceable privacy codes of conduct in specific industries through the collaborative efforts of multi-stakeholder groups, the Federal Trade Commission (FTC), and a Privacy Policy Office within the Department of Commerce". The policy envisages a coordination of multi-stakeholder groups through a new Privacy Policy Office which would work with the FTC, “to develop voluntary but enforceable codes of conduct. Compliance with such a code would serve as a safe harbor for companies facing certain complaints about their privacy practices". Privacy codes of practice have extensive histories in a number of countries outside the United States. At various times, they have been adopted to anticipate privacy legislation, to supplement privacy legislation, to preempt privacy legislation, and to implement privacy legislation. This paper draws upon international experiences and interviews with chief privacy officers to offer important lessons for American policymakers about how codes of practice might best encourage privacy protection on the ground. Despite obvious differences, the Canadian policy experience may be especially instructive. Private sector regulation was originally based on a bottom-up approach through which legislation, called the Personal Information Protection and Electronic Documents Act of 2000, was based on a voluntarily negotiated standard through the Canadian Standards Association (CSA). This in turn was based on existing sectoral codes of practice, of the kind envisaged by the U.S. Department of Commerce. What has been the experience over the last decade? What useful lessons can be drawn for U.S. policy? What are the economic, technological, legal, and social conditions under which codes of practice might promote better privacy protection?

An analysis of the people and groups who have emerged to challenge the increasingly intrusive ways personal information is captured, processed, and disseminated. Today, personal information is captured, processed, and disseminated in a bewildering variety of ways, and through increasingly sophisticated, miniaturized, and distributed technologies: identity cards, biometrics, video surveillance, the use of cookies and spyware by Web sites, data mining and profiling, and many others. In The Privacy Advocates, Colin Bennett analyzes the people and groups around the world who have risen to challenge the most intrusive surveillance practices by both government and corporations. Bennett describes a network of self-identified privacy advocates who have emerged from civil society—without official sanction and with few resources, but surprisingly influential. A number of high-profile conflicts in recent years have brought this international advocacy movement more sharply into focus. Bennett is the first to examine privacy and surveillance not from a legal, political, or technical perspective but from the viewpoint of these independent activists who have found creative ways to affect policy and practice. Drawing on extensive interviews with key informants in the movement, he examines how they frame the issue and how they organize, who they are and what strategies they use. He also presents a series of case studies that illustrate how effective their efforts have been, including conflicts over key-escrow encryption (which allows the government to read encrypted messages), online advertising through third-party cookies that track users across different Web sites, and online authentication mechanisms such as the short-lived Microsoft Passport. In accordance with UNCTAD data, out of 194 countries in the world, 132 countries have enacted laws to protect data and privacy. Among them, most of the laws were issued at the beginning of the 21st century. With the continuous development of digital technology, especially the widespread application of big data technology, existing legislation has been unable to deal with the privacy protection risks brought by new technologies. In recent years, Japan, South Korea, and other countries have begun to revise or expand the definition of personal information protection boundaries and content in laws and regulations to protect the personal information of their citizens in response to the development of new technologies. In early 2020, the COVID-19 epidemic suddenly broke out and quickly swept the world, posing unprecedented challenges to healthcare systems, lifestyles, economic development and social stability in countries around the world. Digital technologies and data applications have played an important role in COVID-19 detection and control, but their characteristics have also raised concerns about the security of personal data and privacy. How the law will be adjusted (or has been adjusted) to deal with new technology will be a challenge.This paper selects the countries (EU, the United States, Japan, South Korea, China) that have modified laws and regulations related to data security and privacy protection in recent years as research objects, analyzes their existing privacy protection laws and regulations governance framework, and then analyzes the privacy risks faced to the new technology. In particular, privacy regulations and compliance guidelines for the application of facial recognition, location tracking and distance learning technology during the COVID-19 epidemic. Then, the governance experience in dealing with the relationship between digital technology progress, personal information protection and public health in the special period was summarized. Finally, it summarizes the future development direction of privacy protection governance from the legal level.
