This book is subversive. It aims to undermine the legal profession's prevailing gladiatorial paradigm. It is, to use Professor Leonard Riskin's phrase, something off "the lawyer's standard philosophical map." It promises a vision of practicing law that is very different than that taught in most American law schools. There exists tremendous discontent among the practicing bar. Many lawyers have found themselves unhappy or unfulfilled in their practices. Compared to other professionals, lawyers suffer disproportionately from excessive stress, substance abuse, and other emotional difficulties. Many find themselves demoralized or disillusioned about the practice of law. Here's the good news: recent years have witnessed a spate of both new and renewed approaches to the practice of law. Disaffected by the adversarial model, many practitioners have engaged in a quiet revolution, a marriage of theory and practice designed to maximize the healing potential of the law. The result has been a variety of approaches such as Therapeutic Jurisprudence, Collaborative Law, and Creative Problem-Solving. Lawyers are cultivating Emotional Intelligence, Multicultural Competence, and Mindfulness. They are developing ways of working consistent with their spiritual and religious beliefs. New pedagogy is informing old courses, and new courses are evolving and taking their places in the curriculums of increasing numbers of law schools. This book bears the fruit of many of these efforts. The twenty contributors to this book come from widely diverse backgrounds. What they share are visions for more therapeutic, more beneficial, more helping, healing ways to practice law. This book is a resource for law professors, law students, and lawyers who share those visions. "After nearly forty years of law practice, I still look forward to coming to work every morning. This is because I have had incredible mentors who have taught me to practice law as a healer and peacemaker. Now my heroes of the comprehensive law movement have each spoken in one outstanding collection edited by Marjorie Silver. Their essays provide a road map for any lawyer to re-invent himself or herself and achieve a law practice filled with joy, meaning and passion. I enthusiastically recommend this book." -- John V. McShane, Esq., Dallas, Texas "Law as a healing profession - Marjorie Silver has collected a series of essays by leading writers engaged in such a career. Readers will find a practical resource to assist in building the emotional competence necessary to practice law in the 21st century. Buy it, read it, and practice in a more enlightened manner! You owe it to your clients, and to yourself." -- G. Andrew H. Benjamin, J.D., Ph.D., Affiliate Professor of Psychology, Antioch University; Affiliate Professor of Law, University of Washington; Director, Parenting Evaluation/Training Program "This book represents a turning point in the history of thought on how attorneys should be trained and how they should practice law. As is true of all pioneering works, this one will go through several stages. At first, traditionalists may oppose it and even ridicule it. Undoubtedly, however, its sheer wisdom will ultimately prevail and eventually be accepted as self-evident." -- Amiram Elwork, Director of the Law-Psychology Graduate Program at Widener University, and author of Stress Management for Lawyers"My experience is that it is a marvelous book and helped lay an academically-sound foundation for the content of course. I learned much from it, and I know our students did too." -- Jonathan R. Cohen, Professor of Law, University of Florida Levin College of Law

Lawmakers and judges often enact and enforce laws and policies that impact youth. The extent to which these legal actions are sensitive to juveniles' perspectives and experiences has changed recently. Compared to an earlier time when juvenlies were treated the same as adults, many policies are now created with the needs of juveniles in mind, thanks in part to psychological studies that have revealed that the decision making, behavior, and cognitions of children vary drastically from those of adults. Unique in its angle and in the breadth of social issues it covers, Psychology, Law, and the Wellbeing of Children brings together new research and analyses to address how legal actions affect children's wellbeing. It addresses how civil and criminal law has evolved to protect, and sometimes inadvertently neglect or harm, the wellbeing and development of children. Each chapter describes a law or policy affecting children, identifies the relevant psychological issues, reviews the research that has been conducted or should be conducted, and provides recommendations for professionals in law and/or psychology. With contributions from top researchers and practitioners in the field, chapters discuss many current debates, including issues such as gender-specific programming for juvenile delinquents, interrogations of juveniles, changes in divorce and custody procedures, programs for imprisoned mothers, and legal actions adopted to protect the health of children and society (e.g., HPV vaccinations, considering child obesity to be abuse). This book will be a vital resource for those interested in protecting the wellbeing of children, including academics and researchers in psychology, criminology, and sociology; practitioners such as judges, attorneys, forensic psychologists, psychiatrists, and social workers; and graduate and law students.

Reparation For Victims Of Crimes Against Humanity written by Jo-Anne Wemmers and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-05-30 with Social Science categories.

Each year, countless people fall victim to crimes against humanity. These include widespread occurrences of systematic murder, torture, rape, disappearances, forced deportation and political persecution. Crimes against humanity constitute an attack on human dignity and as such they violate the human rights of the victim, as well as the laws of humanity. In recent years, following the creation of the International Criminal Court, there has been a growing interest in the prosecution of offenders and, in particular, in reparation following crimes against humanity. While such measures are meant to provide justice for victims, victims are often forgotten or lost in legal debates about what constitutes reparation and who is eligible to receive it. This book reaches beyond the boundaries of law and psychology and takes a multidisciplinary approach to the question of reparation for victims of crimes against humanity. Law does not take place in a vacuum and it is important to consider the impact of the law on the psychology of the victim, as well as the legal principles themselves. Herein lies the originality of this book, which bridges the gaps between psychology, victimology, criminology and law and will be of key interest to academics and students engaged in the study of these areas.

Problem Solving Courts written by Richard L. Wiener and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-07-11 with Psychology categories.

In order to make the criminal court system more effective there has been a growing trend to have courts participate in what is essentially a rehabilitation strategy. Such courts are often referred to as “problem-solving” because they are working on root causes of criminal behavior as part of the dispensation of justice. This major shift in the role of the courts means that the court works closely with prosecutors, public defenders, probation officers, social workers, and other justice system partners to develop a strategy that pressures offenders to complete a treatment program which will ultimately, hopefully prevent recidivism. Research has shown that this kind of strategy has a two-fold benefit. It has been successful in helping offenders turn their lives around which leads to improved public safety and the ultimate saving of public funds. This book is the first to focus exclusively on problem solving courts, and as such it presents an overview of the rationale and scientific evidence for such courts as well as individual sections on the key areas in which these courts are active. Thus there is specific attention paid to domestic violence, juvenile criminality, mental health, and more. Throughout, research findings are incorporated into general discussions of these courts operate and ideally what they are trying to accomplish. There is also discussion of how such courts should evolve in the future and the directions that further research should take.
