"The purpose of this thesis is to explore the relation between law and bioethics for the specific regulation of reproductive health technologies. As traditional policy-making processes fall short in the face of the bioethical intricacies arising with novel assisted reproductive technologies, modern democracies increasingly rely on expert advice provided by National (Bio)Ethics Commissions, Councils, or Committees (NECs). Drawing from entities found in Europe and the USA, an in-depth analysis outlines the benefits of the distinctive functioning and methodology of NECs to inform law and policy-making on morally ambiguous subject-matter. Further, an empirical study reveals the de facto powers of these entities, which have surpassed their purely advisory functions and transformed into active players in the legislative process. Due to general hostility towards NECs found in the literature, this work also aims to dismantle concerns and prove the overarching value of this quasi-legal intervention.Ultimately, the claim of this thesis is that law-makers must defer to NECs to bridge the knowledge gap between science and policy and bring about strong, reasoned, and socially beneficial juridical outcomes"--

The reflexive nature of reason and the unique relationship reason shares with autonomy in Kant's philosophy is the theoretical basis of this dissertation. The principle of respect for autonomy undergirds the two main legal and ethical tenets of genetic counseling, an emerging profession trying to accommodate the sweeping changes that have occurred in clinical genetics, clinical ethics, and case law applicable to medicine. These two tenets of the counseling profession, informed consent and nondirectiveness, both share a principlist interpretation of autonomy that I argue is flawed due to its connection to: instrumental forms of reasoning, empirical theories of action supporting rational choice, and a liberal paradigm of law. I offer an alternative bioethical-legal framework that is based in the Kantian tradition in law and ethics through the complex theories of Jurgen Habermas. Following Habermas's reconstruction of the mutually constituting notions of private and public autonomy, I will argue for a richer conceptualization of autonomy that can have significant implications for the legal and bioethical concepts supporting the profession of genetic counseling, and which can ultimately change counseling practice.

A comparative analysis of the legislation in the field of bioethics in several Western countries, especially in European Union member states, shows that there is a profound difference both in legislative policies and in the ethical principles enshrined by the laws. Over the past few years bioethics, as a discipline, has attempted to elaborate individual and collective behavioural codes in several fields, but it has come up against enormous difficulties; it has not even been possible to reach a consensus between different countries on the general principles. An example of this is the recent Convention on Bioethics endorsed by the Council of Europe. The aim of the essays contained in this book is to highlight the differences between existing regulations in several countries, and to stress how necessary it is to elaborate a legal framework that could be shared by the widest range of national legislations. For there is no denying that technological advances in the fields of both biology and medicine, as well as progress in surgical treatments, mean that jurists the world over are faced with a common scientific reality. The task of the jurist must therefore be to engage in a comparative analysis so as to overcome the differences in national legislations.

Physician-Assisted Death is the eleventh volume of Biomedical Ethics Reviews. We, the editors, are pleased with the response to the series over the years and, as a result, are happy to continue into a second decade with the same general purpose and zeal. As in the past, contributors to projected volumes have been asked to summarize the nature of the literature, the prevailing attitudes and arguments, and then to advance the discussion in some way by staking out and arguing forcefully for some basic position on the topic targeted for discussion. For the present volume on Physician-Assisted Death, we felt it wise to enlist the services of a guest editor, Dr. Gregg A. Kasting, a practicing physician with extensive clinical knowledge of the various problems and issues encountered in discussing physician assisted death. Dr. Kasting is also our student and just completing a graduate degree in philosophy with a specialty in biomedical ethics here at Georgia State University. Apart from a keen interest in the topic, Dr. Kasting has published good work in the area and has, in our opinion, done an excellent job in taking on the lion's share of editing this well-balanced and probing set of essays. We hope you will agree that this volume significantly advances the level of discussion on physician-assisted euthanasia. The goal of this open access book is to develop an approach to clinical health care ethics that is more accessible to, and usable by, health professionals than the now-dominant approaches that focus, for example, on the application of ethical principles. The book elaborates the view that health professionals have the emotional and intellectual resources to discuss and address ethical issues in clinical health care without needing to rely on the expertise of bioethicists. The early chapters review the history of bioethics and explain how academics from outside health care came to dominate the field of health care ethics, both in professional schools and in clinical health care. The middle chapters elaborate a series of concepts, drawn from philosophy and the social sciences, that set the stage for developing a framework that builds upon the individual moral experience of health professionals, that explains the discontinuities between the demands of bioethics and the experience and perceptions of health professionals, and that enables the articulation of a full theory of clinical ethics with clinicians themselves as the foundation. Against that background, the first of three chapters on professional education presents a general framework for teaching clinical ethics; the second discusses how to integrate ethics into formal health care curricula; and the third addresses the opportunities for teaching available in clinical settings. The final chapter, "Empowering Clinicians", brings together the various dimensions of the argument and anticipates potential questions about the framework developed in earlier chapters.

This book provides an analysis of the ways in which the BAC has established an ethical framework for biomedical research in Singapore, following the launch of the Biomedical Sciences Initiative by the Singapore Government. The editors and authors have an intimate knowledge of the working of the BAC, and the focus of the book includes the ways in which international forces have influenced the form and substance of bioethics in Singapore. Together, the authors offer a comparative account of the institutionalisation of biomedical research ethics in Singapore, considered in the wider context of international regulatory efforts. The book reviews the work of the BAC by placing it within the broader cultural, social and political discourses that have emerged in relation to the life sciences since the turn of the 21st century. This book is not primarily intended to be a retrospect or an appraisal of the contribution of the BAC, though this is one aspect of it. Rather, the main intention is to make a substantive contribution to the rapidly emerging field of bioethics. Ethical discussions in the book include consideration of stem cell research and cloning, genetics and research with human participants, and focus on likely future developments as well as the past.Many of the contributors of the book have been personally involved in this work, and hence they write with an authoritative first-hand knowledge that scholars in bioethics and public policy may appreciate. As indicated above, the book also explains the way in which ethics and science ? international and local ? have interacted in a policy setting.
