Cuthbert Whitton was the last of the Malayan Civil Service officers to sit as aHigh Court Judge in Singapore. After a brief prologue introducing Cuthbert's Irish family background, this memoir opens with Cuthbert's arrival inPenang in 1929 as an Eastern cadet with the Malayan Civil Service. He describes colonial life and his duties, includingtaking 'dying depositions' although most dying actually recovered. Cuthbert describes the development of politicalconsciousness, dealing with the resulting issues, and states his own views as he progressed to increasingly senior posts. In1939, after a year reading in Chambers in London, he was called to the Bar by Gray's Inn. He returned to Singapore withthe shadow of war looming, and subsequently would be swept up in the drama of the outbreak of war with Japan. Cuthbert's account of the Fall of Singapore is an extremely personal one; increasing apprehension over militaryaggression in South East Asia, the departure of his wife and infant son, the terror of bombing as the Japaneseadvanced, finally the rounding up of civilians on the Padang followed by the journey by foot to Katong Convent, thenChangi Jail. Apart from commenting on the administration of justice as practised by the Japanese, Cuthbert chosenot to dwell upon internment. After the war, and having recuperated in Ireland, Cuthbert returned to Malaya. He recalls court cases, events such asthe 1948 Emergency when the Communists launched their terrorist campaign, and he comments on the changing times. In 1951 he was appointed Puisne Judge, Federation of Malaya, and 1953 Puisne Judge, Supreme Court, Singapore.

Throughout the British colonies in the nineteenth century, judges were expected not only to administer law and justice, but also to play a significant role within the governance of their jurisdictions. British authorities were consequently concerned about judges' loyalty to the Crown, and on occasion removed or suspended those who were found politically subversive or personally difficult. Even reasonable and well balanced judges were sometimes threatened with removal. Using the career histories of judges who challenged the system, Dewigged, Bothered, and Bewildered illuminates issues of judicial tenure, accountability, and independence throughout the British Empire. John McLaren closely examines cases of judges across a wide geographic spectrum — from Australia to the Caribbean, and from Canada to Sierra Leone — who faced disciplinary action. These riveting stories provide helpful insights into the tenuous position of the colonial judiciary and the precarious state of politics in a variety of British colonies.

The controversial career of John Walpole Willis is re-evaluated in the first comprehensive study of his legal career. Willis, the fifth judge to be appointed to the Supreme Court of New South Wales, served in three colonies, and in each place he wrestled with the role of the law in a rapidly-changing society. In Upper Canada, he confronted the colony's transition from an oligarchy into a nascent democracy; in his next posting, in British Guyana, he was responsible for helping the colony implement, and absorb the consequences of, the abolition of slavery. New South Wales, his final posting, presented unique legal problems as it evolved from a penal colony into a free settlement, and the new settlement at Port Phillip began to grow.To these troubled societies, Judge Willis brought an acute legal mind and a stormy personality - he was twice dismissed from his post by the local Governor. Earlier studies have tended to view him either as a wronged genius or a vain, deranged misfit. Max Bonnell, an experienced lawyer and Adjunct Professor of Law at Sydney University, has rediscovered Willis as a contradictory figure - Australia's first activist judge, who was nonetheless a stickler for the letter of the law; the author of several remarkably humane and enlightened judgments, who was capable of endorsing appalling cruelty; and a man who insisted upon decorum and propriety, yet was undone by his own conspicuous failures of self-control."Willis' story was ripe for the telling, its central protagonist is a character of colour and drama who attracted many a cause célèbre. As one journalist of the time recorded, "as there was no theatre in town, Judge Willis was reckoned to be 'as good as a play'". Max's book is also peppered with amusing titbits from history, from the unlikely first train accident to Willis' family connection to Queen Elizabeth II. While the facts alone paint a fascinating picture, this book is not just a recital of facts; it is accompanied by regular and incisive analysis, a credit to the author's perceptiveness and ability." The memoirs of Sidney Wadsworth are a vital source on Britain's colonial history during the first half of the twentieth century. Recounting his long and distinguished career in the Indian Civil Service, Wadsworth paints an entertaining picture of the many places in Madras province where he served, with illuminating portraits of the important British and Indian figures with whom he associated. Here we see through his eyes the growth of Indian nationalism and the rise of Gandhi, and the impact of the Second World War on Madras. Reliving his journey from junior member of the ICS to High Court judge, Wadsworth displays a shrewd acumen and a keen eye for the ridiculous. By no means uncritical of British rule, he emerges from these pages as a conscientious, humane and reasonable official--unlike some of his contemporaries--and one able to accept the huge changes overtaking India. The physical and moral demands of his daily routine reveal the commitment of an administration that, for all its failings, steadily pursued the goal of good and impartial government. Also featuring excerpts from the memoirs of other civil servants then in the province, A Judge in Madras will fascinate anyone interested in the colonial encounter.

The essays in this volume reflect the exciting new directions in which legal history in the settler colonies of the British Empire has developed. The contributors show how local life and culture in selected settlements influenced, and was influenced by, the ideology of the rule of law that accompanied the British colonial project. Exploring themes of legal translation, local understandings, judicial biography, and "law at the boundaries," they examine the legal cultures of dominions in Canada, Australia, and New Zealand to provide a contextual and comparative account of the "incomplete implementation of the British constitution" in these colonies.

In 2012, the Bombay High Court celebrated the 150th year of its existence. As one of three high courts first set up in colonial India in 1862, it functioned as a court of original and appellate jurisdiction during the British Raj for over 80 years, occupying the topmost rung of the judicial hierarchy in the all-important Bombay Presidency. Yet, remarkably little is known of how the court functioned during the colonial era. The historiography of the court is quite literally anecdotal. The most well known books written on the history of the court focus on humorous (at times, possibly apocryphal) stories about 'eminent' judges and 'great' lawyers, bordering on hagiography. Examining the backgrounds and lives of the 83 judges-Britons and Indians-who served on the Bombay High Court during the colonial era, and by exploring the court's colonial past, this book attempts to understand why British colonial institutions like the Bombay High Court flourished even after India became independent. In the process, this book will attempt to unravel complex changes which took place in Indian society, the legal profession, the law, and the legal culture during the colonial era.

In this collection of essays, leading legal historians address significant topics in the history of judges and judging, with comparisons not only between British, American and Commonwealth experience, but also with the judiciary in civil law countries. It is not the law itself, but the process of law-making in courts that is the focus of inquiry. Contributors describe and analyse aspects of judicial activity, in the widest possible legal and social contexts, across two millennia. The essays cover English common law, continental customary law and ius commune, and aspects of the common law system in the British Empire. The volume is innovative in its approach to legal history. None of the essays offer straight doctrinal exegesis; none take refuge in old-fashioned judicial biography. The volume is a selection of the best papers from the 18th British Legal History Conference.

The first Chief Justice of the United States, John Jay faced many unique challenges. When the stability and success of the new nation were far from certain, a body of federalized American law had to be created from scratch. In The First Chief Justice, New York State Appellate Judge Mark C. Dillon uncovers, for the first time, how Jay's personal, educational, and professional experiences—before, during, and after the Revolutionary War—shaped both the establishment of the first system of federal courts from 1789 to 1795 and Jay's approach to deciding the earliest cases heard by the Supreme Court. Dillon takes us on a fascinating journey of a task accomplished by constant travel on horseback to the nation's far reaches, with Jay adeptly handling the Washington administration, Congress, lawyers, politicians, and judicial colleagues. The book includes the history of each of the nine cases decided by Jay when he was Chief Justice, many of which have proven with time to have enduring historical significance. The First Chief Justice will appeal to anyone interested in the establishment of the US federal court system and early American history.

This book is the first study of the development and decolonization of a British colonial high court in Africa. It traces the history of the High Court of Tanzania from its establishment in 1920 to the end of its institutional process of decolonization in 1971. This process involved disentangling the High Court from colonial state structures and imperial systems that were built on racial inequality while simultaneously increasing the independence of the judiciary and application of British judicial principles. Feingold weaves together the rich history of the Court with a discussion of its judges – both as members of the British Colonial Legal Service and as individuals – to explore the impacts and intersections of imperial policies, national politics, and individual initiative. Colonial Justice and Decolonization in the High Court of Tanzania is a powerful reminder of the crucial roles played by common law courts in the operation and legitimization of both colonial and post-colonial states.
