The geopolitics of American law enforcement and how it changed corporate criminal accountability in other countries Over the past decade, many of the world’s biggest companies have found themselves embroiled in legal disputes over corruption, fraud, environmental damage, tax evasion, or sanction violations. Corporations including Volkswagen, BP, and Credit Suisse have paid record-breaking fines. Many critics of globalization and corporate impunity cheer this turn toward accountability. Others, however, question American dominance in legal battles that seem to impose domestic legal norms beyond national boundaries. In this book, Cornelia Woll examines the politics of American corporate criminal law’s extraterritorial reach. As governments abroad seek to respond to US law enforcement actions against their companies, they turn to flexible legal instruments that allow prosecutors to settle a case rather than bring it to court. With her analysis of the international and domestic politics of law enforcement targeting big business, Woll traces the rise of what she calls “negotiated corporate justice” in global markets. This 2018 Article IV Consultation highlights that a mild recovery supported by accommodative monetary and fiscal policies is currently under way in Brazil. But the economy is underperforming relative to its potential, public debt is high and increasing, and, more importantly, medium-term growth prospects remain uninspiring, absent further reforms. Against the backdrop of tightening global financial conditions, placing Brazil on a path of strong, balanced and durable growth requires a committed pursuit of fiscal consolidation, ambitious structural reforms, and a strengthening of the financial sector architecture. Following the severe recession in 2015-16, real GDP grew by 1 percent in 2017. Growth is projected to be 1.8 and 2.5 percent in 2018 and 2019, respectively, driven by a recovery in domestic consumption and investment.

The Interoceanic Highway is many things to many people: an emblematic project during a period focused on integration, a dream realized for an isolated region, a symbol of the profound fragility of state institutions, a key cause of political corruption, and a major driver of ecological and cultural devastation. This highway links the Andean highlands with the Amazonian lowlands in southern Peru, offering an outlet for Brazil’s emergent economy. While it finally brought an end to the isolation of Madre de Dios and other parts of southern Peru and the western Amazon, it was made possible by political corruption revealed in the Lava Jato scandal, and it permitted the spread of criminal business activities. Developing countries lose billions each year through bribery, misappropriation of funds, and other corrupt practices. Much of the proceeds of this corruption find 'safe haven' in the world's financial centers. These criminal flows are a drain on social services and economic development programs, contributing to the impoverishment of the world's poorest countries. Many developing countries have already sought to recover stolen assets. A number of successful high-profile cases with creative international cooperation has demonstrated that asset recovery is possible. However, it is highly complex, involving coordination and collaboration with domestic agencies and ministries in multiple jurisdictions, as well as the capacity to trace and secure assets and pursue various legal options—whether criminal confiscation, non-conviction based confiscation, civil actions, or other alternatives. This process can be overwhelming for even the most experienced practitioners. It is exceptionally difficult for those working in the context of failed states, widespread corruption, or limited resources. With this in mind, the Stolen Asset Recovery (StAR) Initiative has developed and updated this Asset Recovery Handbook: A Guide for Practitioners to assist those grappling with the strategic, organizational, investigative, and legal challenges of recovering stolen assets. A practitioner-led project, the Handbook provides common approaches to recovering stolen assets located in foreign jurisdictions, identifies the challenges that practitioners are likely to encounter, and introduces good practices. It includes examples of tools that can be used by practitioners, such as sample intelligence reports, applications for court orders, and mutual legal assistance requests. StAR—the Stolen Asset Recovery Initiative—is a partnership between the World Bank Group and the United Nations Office on Drugs and Crime that supports international efforts to end safe havens for corrupt funds. StAR works with developing countries and financial centers to prevent the laundering of the proceeds of corruption and to facilitate more systematic and timely return of stolen assets.

As the world moves towards decarbonization and the race for clean energy technologies accelerates, states in the global south are increasingly called upon to supply critical minerals to fuel the transition. Business of the State details how mineral states might design effective growth strategies in this context of strategic competition and climate emergency, via the rise of a hybrid developmental strategy during 1990s and 2010s- the embrace of market-conforming policies to attract FDI and the re-assertion of state-owned enterprises (SOEs) as players in industrial development. Drawing from the experiences of Brazil's Petrobras and Chile's Codelco, the book argues that SOEs might open new pathways for technological innovation and even support industrial policy, if subjected to effective governance reforms and aligned with the private sector. In this way, the book shifts the analytical lens away from extractivism as a growth model and towards hybrid development strategies formulated through SOEs. Business of the State asks fundamental questions about states and markets: why do states seek to intervene in the affairs of public enterprises? And what role might they play in structural transformation?
