Excerpt from The Law of Married Women in New Jersey Obvious reasons argue for the publication of this work: the importance of the subject; the complexity of the law respecting it; and the author's belief-the result of a critical examination of the subject for some years past-that he has made it possible for members of the Bar to quickly ascertain what the statutes and decisions in this State about the subject are, and where they are. As a time-saver alone its value should prove immense to the busy practitioner. As a guide to the law it does not give the author's own opinions, but confines itself to the statutes of this State and to the actual decisions of its courts based thereon. Many appended notes to the cases (inserted in brackets) call attention to valuable collateral questions discussed in the quoted text. While the plan of the work is an unusual one, it is believed to be (for a single State), a sound and very useful one. Our own courts provide a wide range of authoritative decisions and justly expect their practitioners to cite them. To present these cases a digest must be carefully conned, often under various heads; then later reports consulted; then the "Atlantic Reporter" and, occasionally, the "New Jersey Law Journal" looked into; then the cases cited in each critically examined, and cases criticising or affirming the principal case: then the years of the decisions noted; then the statutes in force, when these decisions were made, must be marked and compared with existing statutes. To omit any one of these steps may unnecessarily place one's client and one's self at the mercy of a more diligent student. The subjects under each of the two parts of this book are alphabetically arranged in chapters, and each chapter divided into sections containing the propositions of law embraced in what immediately follows. Excerpt from On the Laws Relating to the Property of Married Women I am not going to consume much time in arguing about Question of the abstract justice of such a bargain. Probably all of as have $2553? Lately read with interest an argument by an eloquent lady to prove the natural equality of the sexes of mankind. I pass by that question entirely. I Will assume, with that lady's opponents, Who, be it observed, are the same class of thinkers that oppose any alteration of the law of property, that men in general are superior to women in general in moral and intel lectual, as they are in muscular, force. Let us say that they have stronger bodies, stronger understandings, and stronger Wills. Should the law then, on this account, throw all its protection round the stronger party at the expense of the weaker? Those who insist most eagerly on the superior strength of men ought to feel most keenly the inequality of the law. It is idle to say that it ought to be left to the stronger to act for the common interests of the two. As long as their interests are really in common no question will arise, whatever the state of the law may be. But it cannot be denied that; in point of fact, the interests of many married couples do, in many cases, diverge. I want to know Why, in such cases, the Whole weight of the law should, so far as regards property, be on the side of the one Who already has enormous practical advantages by reason of his superior strength. Excerpt from A Treatise on the Law of Husband and Wife The ground-work of the present volume on the law of Husband and Wife will be found in a treatise of some three hundred pages which the author's earlier work on the Domestic Relations contains. But when that treatise was written, the Married Women's Acts in England and America were a sort of first experiment or agitation; and since the second edition of the Domestic Relations not less than three thousand points have been decided, all tending to establish a mod ern jurisprudence concerning married women's rights, which decisions the author has examined while pre paring the present work, in addition to earlier author ities and various local codes. He has consequently expanded his subject, re-arranged his plan, and revised and re-written every topic, and the present work will be found essentially a new one, so far as relates espe cially to Promises to Marry, the Wife's Separate Pr0p erty under Equity and Recent Statutes, Transactions between Husband and Wife, Various Matters of Prac tice, and Separation and Divorce. A summary of the late Married Women's Acts in England and the United States will be found in the Appendix. No one can gain an intelligent comprehension of the rights and disabilities of the marriage union, as they exist to-day, without examining in order, (1) the old common-law or coverture doctrine; (2) the modifica tion of that doctrine by equity and recent legislation; (3) the latest local statute (judicially construed or not) which bears upon the particular point. The law is a system of rules, in a measure technical and artificial, eliminated in the main from judicial decisions, by judges, by legal practitioners, and by text-writers, added to, modified, perfected, and made more binding from age to age, the work'of multitudes of minds, the growth of centuries. It is composed of what, for the want of a better word, are called reasons but they are not the reasons of able men destitute of legal education, they are legal reasons. Or, we say it is composed of principles; but they are not the principles of honest men who are not lawyers, they are legal principles. In a still other form of the expression, they are doctrines of the law, though this phrase is not quite the equivalent of either of the others. Again, the expression rule of law does not differ greatly from any one of the others, but it is not quite identical. Excerpt from A Concise View of the Law of Husband and Wife as Modified by the Married Women's Property Acts: With an Appendix of Statutes The theory of the old law was that husband and wife are one person. The fundamental principle of the new law is that husband and wife are distinct persons, with independent, and possibly conflicting, rights. I have endeavoured to state the old law - shortly, since existing standard works seem to render a fuller statement uncalled for - and to show the altera tions made by the new law, with its varied application according to the date of marriage. The Married Women's Property Act, 1882, has left much to be supplied by judicial interpretation, the burden of which for some time will rest upon the judges of the County Court. I have endeavoured to suggest solutions of some of the many doubts arising upon the construction of this Statute, which will probably be found to be more far-reaching than its authors contemplated, and more radical than a casual perusal of its provisions might suggest. This work, which it was intended should appear with the commencement of the Act, has been delayed by pressure of other matters.
