Excerpt from The Law of the American Constitution, Vol. 1: Its Origin and Development The American federal system is based upon the Consti tution of the United States. That instrument was adopted to make more perfect the union which, having had its beginning in the common allegiance of the colonies to the British Crown during the war for independence, was welded closer by the necessity for common action, and found its first constitutional expression in the Articles of Confedera tion. Nineteen articles of amendment have been added to the Constitution in the hundred and thirty-four years since its adoption. It is hoped that in the first three chapters of this book a clear picture is given of the making of the Constitution, of the nature of the federal system which was set up, and of the principles which underlie the amending power. The Constitution of the United States first of all estab lishes a national government, and sets off to it certain fields in which it shall be supreme, at the same time imposing upon it certain specific prohibitions and restrictions. It was, however, very far from the purpose of the framers of that instrument to do away with the separate States or to reduce them to mere administrative units. Yet the grants of powers to the national government did of necessity operate as limitations upon the previous sovereign powers of the States; and to these implied limitations were added others which are express. In the second part of this book, I have dealt with the national government in its executive, judicial, and legislative departments, discussing the powers which are granted to each of them, and the limitations which are placed upon their activities. In Part III are con sidered the restrictions placed upon the States, and the extent of the powers which may still be exercised by them. It is believed that this is a logical method of treatment, and it is hoped that it will help to make clear the division of powers between the national and state governments under our federal system. No attempt has been made to treat of the powers of the States under their individual constitutions. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. American Constitutional Law provides a comprehensive account of the nation’s defining document. Based on the premise that the study of the Constitution and constitutional law is of fundamental importance to understanding the principles, prospects, and problems of America, this text puts current events in terms of what those who initially drafted and ratified the Constitution sought to accomplish. The authors examine the constitutional thought of the founders, as well as interpretations of the Constitution by the Supreme Court, Congress, the President, lower federal courts, and state judiciaries. Now fully updated, the eighth edition of this classic volume focuses on individuals’ rights and responsibilities and incorporates nine new cases, including District of Columbia v. Heller, In re Marriage Cases, Kennedy v. Louisiana, and Parents Involved in Community Schools v. Seattle School District No. 1. Also available in its eighth edition from authors Ralph A. Rossum and G. Alan Tarr: American Constitutional Law, Volume I: The Structure of Government (Westview Press, ISBN 978-0-8133-4477-5).

Excerpt from Law Dictionary, Adapted to the Constitution and Laws, Vol. 1: United States of America, and of the Several States of the American Union; With References to the Civil and Other Systems of Foreign Law IT has been the purpose of the Editor in preparing this his Third Revision to treat much more fully all encyclopaedic titles, except those in which there has been no development in recent years, while adding many dictionary and other minor titles not found in the last Revision. These objects and the great changes since 1898, the date of the last Revision, in the questions which have occupied the courts, have required the extension of the work to three volumes. The titles of both State and Federal cases have for the first time been inserted, as well as the volumes of the different series of reports other than those of the official series. Titles of a statutory and changing nature have been treated less fully, so as to avoid purely ephemeral matter. Judge Baldwin (modern Political Institutions 241) quotes Jeremiah Mason as saying that the development of an American Jurisprudence can only be looked for from the courts of the National Government. The Editor has been guided by that thought and sees in it a hope of increasing uniformity of law, towards which the profession, in its work on uniform legislation, is making real progress. He has therefore constantly cited the decisions of the Supreme Court of the United States and very frequently those of the lower Federal Courts. Of course, on many of the questions now being passed upon by the State Courts, the decisions of the Supreme Court are of binding authority. This paperback volume (subtitled "Constitutional Rights: Civil Rights and Civil Liberties") includes chapters 10 through 19 of Fisher/Harriger, American Constitutional Law, Ninth Edition (hardback). Now in its ninth edition, American Constitutional Law is the only book that develops constitutional law in the comprehensive sense. Along with containing analyses and excerpts of court decisions, the book highlights the efforts of legislatures, executives, the states, and the general public to participate in an ongoing political dialogue rather than passively receive a series of unilateral judicial commands. It covers all new developments in case law, congressional statutes, presidential policies, and initiatives undertaken by states under their own constitutions. The book includes readings not only from cases but congressional floor debates, committee reports, committee hearings, presidential vetoes and other statements, state actions, Federalist papers, and professional journals. It also includes a chapter on equal protection that addresses immigration law and the rights of aliens.
