Excerpt from The Law Reports, 1872, Vol. 7 The plaintiffs are the proprietors of a weekly periodical called "Punch." Between the years 1849 and 1867 they published in nine several numbers nine cartoons, with descriptive writing underneath them with reference to the Emperor Napoleon III. In 1871 the defendant published a work called "The Man of his Time," consisting, first, of the "Story of the Life of Napoleon III., by James M. Haswell;" and, secondly, of "The same Story as told by Popular Caricaturists of the last Thirty Years." Among the caricatures in part 2, were copies in a reduced form, sometimes with and sometimes without the descriptive writing, of the nine cartoons above mentioned. No consent from the plaintiffs to this production had been obtained. In an action by them for infringement of their copyright in the several books or "sheets of letterpress" containing the cartoons: - Held, that a substantial part of the plaintiffs' books, or sheets of letterpress, had been appropriated, and that they were entitled to recover. The trial Judge refused to recall the jury and refused to grant a reserved case. The accused now applies; to this Court for leave to appeal, and on the argument before us counsel for the Crown agreed that we should deal with the matter as if a case had been stated. The following portions of the J udge's charge are, in my opinion, the only ones material to the consideration of the question: "However, this case, like so many unfortunate cases of a similar nature, involves the question of which of two witnesses to believe. You have the two contradictory stories one told En Base. 1914 by Mrs. Sholts, the other by the accused, Schurman," and again' gCHUB'MAN_ "You are the sole judges of the facts. You have heard the evidence of both parties, and it is for you to say which of the-stories is to be believed. You are not bound by any expression of opinion I may make on the facts. It is for you to say which witness you are to believe," and further, "I must say that it makes it very dilficult for you, because there is so little to help you to come to a conclusion. But you must form a conclusion from the evidence. It is for you to say which of these two parties is telling the truth. If you believe that the story of the woman is the correct one, then you must find that the accused is guilty of an attempt to commit the offence charged. If, on the other hand, you believe that the story of the man is correct, then you must find that the woman is a woman of loose character, and, more than that, that she is guilty of telling deliberate lies in.the witnessbox.
