Over the 1980s and 1990s, most Latin American countries witnessed a retrenchment of the public sector away from infrastructure provision and an opening up of infrastructure activities to the private sector. This book analyzes the consequences of these policy changes from two perspectives. First, it reviews in a comparative framework the major trends in infrastructure provision in Latin America over the last two decades. Second, it evaluates the implication of these trends for economic growth and public deficits in the region. The book shows that in most countries private participation did not fully offset the public sector retreat. The result was a slowdown in infrastructure accumulation, which entailed a significant growth cost and weakened the intended impact of the infrastructure spending cuts on public sector insolvency.

The events surrounding Gazprom obtaining a controlling stake in the Production Sharing Agreement (PSA)-governed Sakhalin-2 presents a useful historical case study for examining the limits of stabilization clauses for safeguarding transnational oil and gas investments in emerging markets. The Sakhalin-2 PSA's broad stabilization clause applied to any type of legislative modification that prejudiced the investors' rights. However, the Russian government was able to circumvent the clause's promise: it achieved equity participation in the project and a greater share of its gains by invoking environmental protection legislation to re-negotiate the PSA's fiscal terms. This twist in events makes it worthwhile to reexamine the extent of utility of even the most pro-investor contractual stabilization clauses. The Sakhalin-2 type clause provides a weak legal basis for protection of investors as a contractual matter because under the PSA's provisions, mandatory law would exclude environmental regulations from the scope of stabilization. Because the actual content of the stabilization clause is capable of being ascertained from other terms of the PSA and must be considered against the background of National law, it also follows that as a bilateral investment treaty (BIT) matter, the breach of an umbrella clause claim would lack basis and the PSA's stabilization provisions would not constitute a legitimate expectation for a convincing fair and equitable treatment (FET) violation claim, including under the rubric of good faith and detrimental reliance on the clause on its face.

Abstract : A protocol is said to be self-stabilizing when the distributed system executing it is guaranteed to recover from any fault that does not cause permanent damage. Designing such protocols is hard since they must recover from all possible states, therefore we investigate how feasible it is to synthesize them automatically. We show that synthesizing stabilization on a fixed topology is NP-complete in the number of system states. When a solution is found, we further show that verifying its correctness on a general topology (with any number of processes) is undecidable, even for very simple unidirectional rings. Despite these negative results, we develop an algorithm to synthesize a self-stabilizing protocol given its desired topology, legitimate states, and behavior. By analogy to shadow puppetry, where a puppeteer may design a complex puppet to cast a desired shadow, a protocol may need to be designed in a complex way that does not even resemble its specification. Our shadow/puppet synthesis algorithm addresses this concern and, using a complete backtracking search, has automatically designed 4 new self-stabilizing protocols with minimal process space requirements: 2-state maximal matching on bidirectional rings, 5-state token passing on unidirectional rings, 3-state token passing on bidirectional chains, and 4-state orientation on daisy chains.

The COVID-19 pandemic presents a challenge for stabilization policy that is different from those resulting from either "supply" or "demand" shocks that similarly affect all sectors of the economy, owing to the degree to which the necessity of temporarily suspending some (but not all) economic activities disrupts the circular flow of payments, resulting in a failure of what Keynes (1936) calls "effective demand." In such a situation, economic activity in many sectors of the economy can be much lower than would maximize welfare (even taking into account the public health constraint), and interest-rate policy cannot eliminate the distortions -- not because of a limit on the extent to which interest rates can be reduced, but because monetary stimulus fails to stimulate demand of the right sorts. Fiscal transfers are instead well-suited to addressing the fundamental problem, and can under certain circumstances achieve a first-best allocation of resources without any need for a monetary policy response.
