Excerpt from The Law and the Woman By study and comparison of the laws of the several States in their relation to women may be evolved such legislative measures as will tend to establish a fair legal status for women, which would mean a government of the people, for the people and by the people, along with the concession that women are people. The power is vested in the legislatures of the several States to make, ordain and establish all manner of laws, statutes and ordinances not repugnant to the Constitution and deemed for the best good and interest of the Common wealth. It is by and through these law making bodies women must establish their protective and defensive measures and these measures should be so fair, sane and equitable as to command universal respect and confidence. Careful and intelligent progress by women in the shaping of such new laws as are intended to equalize their status with the male citizen will best demonstrate their right to citizenship with its resultant obligations and duties, for in the multiplicity of laws now cluttering our statute books a few more, unless direct, forceful and valid, will but add to the confusion and defeat their purpose. It may be well to recall the fact that in 1913 more than two thousand bills were introduced in the Wisconsin legislature, of which eight hundred and twenty three were passed. The law making bodies of other States stagger, session after session, under equally heavy burdens. Wherefore it would seem that a Bureau of Legislation, with women fairly represented, to which all bills would have to be submitted for approval before introduction. The recent graduate himself, wrestling with his earliest practical problems, is especially prone to lay his troubles at the door of the law school. Without stopping to inquire in what other directions the law school has come short of its duty to the student, law teachers generally must concede that while a knowledge of law books and their use - in short, brief-making, in its broader sense is an essential professional acquirement, this field is yet, for the average law-school graduate, a vast waste of uncharted and unexplored territory. Following precedent, the teacher has been content to lay before the student, in the form of lectures, text-books or cases, or these combined, principles of the teacher's own choosing; but little or no necessity for sus taining or combating a particular proposition by written argu ment is encountered by the student while in the law school. If, says Mr. Taylor, the rules of exclusion, recognized till lately by the English law, had been really founded, as they purported to be, on public experience, they would have furnished a omost revolting pic ture of the ignorance and depravity of human nature. The second volume contains ninety more pages, and the third volume one hundred and sixty-three more pages than they contained in the first edition. During the thirteen years which have elapsed since the publication of the first edition, my knowledge of different parts of the subject has naturally increased, and I have become conscious of the inadequacy of my treatment of parts of the subject. It is for this reason that I have added introductions to Books II. and III., that I have added a new first chapter to the First Part of Book III., and that I have rearranged Chapters II. and IV. of that part. It is partly for the same reason that I have made very considerable alterations in all the chapters of Part II. of Book III. which is contained in Volume III.
