Drawing on an original survey of more than 5,000 respondents, this book argues that, contrary to claims by the 1994 Zapatista insurgency, indigenous and non-indigenous respondents in southern Mexico have been united by socioeconomic conditions and land tenure institutions as well as by ethnic identity. It concludes that - contrary to many analyses of Chiapas's 1994 indigenous rebellion - external influences can trump ideology in framing social movements. Rural Chiapas's prevalent communitarian attitudes resulted partly from external land tenure institutions, rather than from indigenous identities alone. The book further points to recent indigenous rights movements in neighboring Oaxaca, Mexico, as examples of bottom-up multicultural institutions that might be emulated in Mexico and elsewhere in Latin America.

The farming community of Chan thrived for over twenty centuries, surpassing the longevity of many larger Maya urban centers. Between 800 BC and 1200 AD it was a major food production center, and this collection of essays reveals the important role played by Maya farmers in the development of ancient Maya society. Chan offers a synthesis of compelling and groundbreaking discoveries gathered over ten years of research at this one archaeological site in Belize. The contributors develop three central themes, which structure the book. They examine how sustainable farming practices maintained the surrounding forest, allowing the community to exist for two millennia. They trace the origins of elite Maya state religion to the complex religious belief system developed in small communities such as Chan. Finally, they describe how the group-focused political strategies employed by local leaders differed from the highly hierarchical strategies of the Classic Maya kings in their large cities. The present is a case study of a very interesting indigenous community in Oaxaca Mexico. The diversity of the indigenous cultures, their struggles, resistances and symbolic beliefs are embedded in their everyday life. The modern state-nations embody that idea in themselves since the binomial character of nation and state tends to legitimise the construction of bounded systems of homogenous situations which may be manipulated, shaped and re-designed according to a teleological ‘ideal’ about how the society ought be rather that understand how it is. Paradoxically, the modern communication, the wider access to technology and information produce the rough material to create contest proposal in multiple and unpredictable ways.

The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Is it possible to decolonize, decommodify, and depatriarchalize the constitution? The authors speak from multiple geographies, raise different questions, resort to differentiated theoretical approaches, and reveal varying levels of optimism about the possibilities of transforming constitutions.
