State Medicaid programs transfer over $100 billion to private firms to manage the health care needs of beneficiaries every year. As a result of state policy choices, there is a great deal of variation among the states in the scope and use of managed care organizations to serve state Medicaid populations. This research answers questions about what factors help to explain the variations among states; with a specific emphasis on both the role of interest group populations and bureaucratic capacity. The questions posed are answered utilizing pooled, cross-sectional time series analysis from 1997 to 2007 to test the relationship between Medicaid managed care policy choices and a variety of political, economic, demographic and governmental control variables. In addition, a four state case study analysis was conducted with similar policy players in each state that utilizes content analysis software to examine transcribed interview response variations about state Medicaid privatization efforts. The findings from the quantitative models suggest that interest groups play an important role in explaining why states choose to use commercial for-profit managed care arrangements. The models also find that states with higher levels of bureaucratic capacity tend to rely less on the use of all forms of managed care in Medicaid contracting, and that state specific managed care markets are positively related to state managed care policy choices. The four state qualitative interviews confirm the accuracy of the statistical analysis and further provide a narrative explaining why states favor one type of Medicaid managed care use. In addition, the interviews clarify how strong interest group communities and diminished bureaucratic capacity explain a state's policy choices. The findings contribute to the state policy and politics literature and health policy making about the role of bureaucracy and interest groups and are generalizable to other state policy venues.

Markets, not politics, are driving health care reform in America today. Inventive entrepreneurs have transformed medicine over the past ten years, and no end to this period of rapid change is in sight. Consumer anxieties over managed care are mounting, and medical costs are again soaring. Meanwhile, the federal government remains mostly on the health policy sidelines, as it has since the collapse of the Clinton administration's campaign for health care reform. This book addresses the changes that the market has wrought- and the challenges this transformation poses for courts and regulators. The law that governs the medical marketplace is an incomplete, overlapping patchwork, conceived mainly without medical care specifically in mind. The ensuing confusion and incoherence are a central theme of this book. Fragmentation of health care lawmaking has foreclosed coordinated, system-wide policy responses, and lack of national consensus on many of the central questions in health care policy has translated into legal contradiction and bitter controversy. Written by leading commentators on American health law and policy, this book examines the widely-perceived failings of managed care and the law's relationship to them. Some of the contributors treat law as a cause of trouble; others emphasize the law's potential and limits as a corrective tool when the market disappoints. The first two chapters present contrasting overviews of how the doctrines and decision-makers that constitute health law work together, for better or worse, to constrain the medical marketplace. The next six chapters address particular market developments and regulatory dilemmas. These include the power of state versus federal government in the health sphere, conflict between insureres and patients and providers over medical need, financial rewards to physicians for frugal practice, the role of antitrust law in the organization of health care provision and financing, the future of public hospitals, and the place of investor-owned versus non-profit institutions. Why government outsourcing of public powers is making us less free Many governmental functions today—from the management of prisons and welfare offices to warfare and financial regulation—are outsourced to private entities. Education and health care are funded in part through private philanthropy rather than taxation. Can a privatized government rule legitimately? The Privatized State argues that it cannot. In this boldly provocative book, Chiara Cordelli argues that privatization constitutes a regression to a precivil condition—what philosophers centuries ago called "a state of nature."
